Bloomingdale’s Parking Lot Fall Alleged In Boca Raton Lawsuit

A Palm Beach County complaint claims a woman suffered injuries after falling on an allegedly unsafe parking lot surface near Bloomingdale’s in Boca Raton.

The complaint was filed in Palm Beach County Circuit Court over an alleged parking lot fall near Bloomingdale’s on W. Glades Road in Boca Raton.

BOCA RATON, FL — A parking lot near Bloomingdale’s on West Glades Road is now at the center of a Palm Beach County civil lawsuit.

The complaint claims Iris Rothstein fell while walking toward the entrance of the Boca Raton Bloomingdale’s store after encountering an uneven, broken, raised or otherwise dangerous condition in the parking lot.

The case is Iris Rothstein v. Bloomingdale’s LLC, Macy’s Retail Holdings, LLC, Simon Property Group, Inc. and Jane Doe, Case No. 502026CA006527XXXAMB, filed June 11, 2026, in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County. The filing was submitted by attorney Carissa M. Peebles of Morgan & Morgan, P.A., according to the complaint.

The lawsuit identifies the location as the parking lot in front of and adjacent to 5840 W. Glades Road, Boca Raton, FL 33431. The complaint alleges the parking lot was open to guests of the defendants, including Rothstein, when the incident occurred on or about Oct. 23, 2025.

According to the complaint, Rothstein was lawfully walking on the parking lot toward Bloomingdale’s when she tripped and fell because of the alleged condition of the surface.

The lawsuit claims the parking lot had an unlevel, broken, raised or otherwise dangerous condition. The complaint also alleges that sections of the lot were uneven, cracked, contained potholes, divots or abrupt changes in elevation, and that the defendants knew or should have known about the condition.

The claims are allegations made in a civil court filing and have not been proven in court.

The complaint brings negligence claims against Bloomingdale’s LLC, Macy’s Retail Holdings LLC, Simon Property Group Inc. and an unnamed Jane Doe. Jane Doe is described in the filing as a manager connected to Simon Property Group who allegedly had responsibility for ensuring the premises were maintained in a safe manner.

The lawsuit alleges the defendants failed to properly maintain, inspect, repair, warn about or block access to the alleged condition in the parking lot. It also claims they failed to take reasonable steps to correct the condition before Rothstein’s fall.

Rothstein claims she sustained permanent and severe bodily injuries as a result of the fall. The complaint seeks damages in excess of $50,000, plus interest and costs. The filing also includes a demand for a jury trial.

The filing reviewed by Boca Post does not include a response from the defendants.
