BOCA RATON, FL — A Boca Raton TJ Maxx store is facing a civil negligence lawsuit in Palm Beach County after a shopper alleged she slipped and fell on a puddle of water inside the store during heavy rain, according to a complaint filed in circuit court.
The lawsuit was filed by Bonnie Marrone, identified in the complaint as a Palm Beach County resident. She named as defendants The TJX Companies, Inc., which does business as TJ Maxx, and a store employee identified only as Jane Doe. The case, Marrone v. The TJX Companies, Inc., was filed July 23, 2026, in the Circuit Court for the Fifteenth Judicial Circuit in and for Palm Beach County under case number 502026CA008283XXXAMB. Court records list Patrick W. Knight of The Grife Law Firm, P.A., a Boca Raton firm, as the attorney for the plaintiff.
According to the complaint, the incident happened on or about September 21, 2025, at the TJ Maxx at 8903 Glades Road in Boca Raton. The filing states Marrone was shopping inside the store as a business invitee when she slipped and fell on a puddle of water on the floor.
The lawsuit alleges that it had been pouring rain outside for a considerable time before the fall and that customers were tracking water into the store, leaving small puddles throughout. The complaint claims the puddle that caused the fall was in an area frequently walked through by shoppers and a considerable distance from the front entrance. The water had streaks running through it, the complaint alleges, indicating that several people had walked through the area before Marrone and that the puddle had been present long enough to be discovered.
The complaint alleges the store failed to take precautions such as using enough floor mats to absorb the water, providing umbrella stands or umbrella bags, mopping up the puddles, or putting out warning signs about the wet floor. The lawsuit alleges the water was an unsafe and dangerous condition and that the store knew or should have known about it.
The complaint brings three counts. Count I alleges negligence against The TJX Companies, claiming the company, as owner and operator of the store, breached a duty to keep the premises reasonably safe for shoppers. Count II alleges negligence against the employee identified as Jane Doe, whom the complaint describes as responsible for monitoring and cleaning the area of the fall. Count III alleges vicarious liability against The TJX Companies under the legal doctrine of respondeat superior, which can hold an employer responsible for an employee's actions taken within the scope of the job.
The lawsuit alleges Marrone suffered permanent bodily injury, aggravation of a pre-existing condition, scarring and disfigurement, pain and suffering, mental anguish, medical bills, and lost income and earning capacity. The complaint describes the injuries as permanent or continuing.
The complaint states the action is for damages in excess of $50,000, exclusive of interest and costs. The filing seeks a judgment against the defendants for damages to be determined at trial, together with interest and costs, and demands a trial by jury on all issues.
