Lauderdale Lakes Man Sues DME Medical, Alleges Wheelchair Repair Caused Fall

A Lauderdale Lakes wheelchair user has filed a negligence lawsuit in Broward County Circuit Court against DME Medical Supplies & Complex Rehab, alleging an improper wheel repair caused him to be thrown from his chair inside his home.

Lauderdale Lakes Man Sues DME Medical, Alleges Wheelchair Repair Caused Fall

LAUDERDALE LAKES, FL — A Lauderdale Lakes wheelchair user is suing a Florida medical equipment company in Broward County Circuit Court, alleging that an improper wheel repair by a company technician caused him to be thrown from his wheelchair inside his home, according to a newly filed complaint.

Brandon Jean filed the negligence lawsuit against DME Medical Supplies & Complex Rehab, Inc., formerly known as DME of America One, Inc., on July 9, 2026, in the 17th Judicial Circuit in and for Broward County. The case, Brandon Jean v. DME Medical Supplies & Complex Rehab, Inc., was assigned Case No. CACE-26-011146 and Division 14, court records show.

Jean is represented by Kristian Bie of the LaBovick Law Group in Palm Beach Gardens, according to the complaint. The filing does not list defense counsel.

The complaint alleges Jean is disabled and requires the use of a wheelchair. On or about July 16, 2024, he contacted DME Medical to repair the wheels of his wheelchair, the filing says. The company sent a repair technician to Jean's home in Lauderdale Lakes that same day, according to the complaint.

The lawsuit alleges the technician told Jean he was new to the company and still required supervision and training from his supervisor, identified in the complaint only as "Richard," the regular repair technician. Richard did not accompany the technician to Jean's home, the filing states.

When the technician finished the work, he allegedly left zip ties on the wheels that appeared to be holding the wheels in position, according to the complaint.

After the technician left, Jean attempted to sit in the wheelchair, the filing says. The complaint alleges that instability in the wheels, which the lawsuit describes as caused by improper repairs, threw Jean from the chair onto the floor of his home.

The complaint alleges Jean remained on the floor unable to get up until a family member arrived and assisted him using a sheet.

The lawsuit brings a single count of negligence against DME Medical, alleging the company failed to properly inspect, service and repair the wheelchair, created a dangerous condition through allegedly negligent repairs, and failed to warn Jean of that condition. The complaint also alleges DME Medical breached its duty of care by sending a technician who did not have sufficient skill, education, training or experience to properly repair the wheelchair, and that the company is vicariously liable for the technician's actions.

Jean is seeking damages in excess of $50,000, plus taxable costs and attorneys' fees as allowed by law, according to the complaint. The filing also demands a jury trial.

The complaint alleges Jean suffered bodily injury, pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, medical and nursing expenses and aggravation of a previously existing condition, and that some of those losses are permanent or continuing.

The filing reviewed by Boca Post does not include a response from the defendant. The allegations in the complaint have not been proven in court.
