Freedom Mortgage Files Foreclosure Suit Over Boca Raton Property

BOCA RATON, FL (Boca Post) (Copyright © 2025) — Freedom Mortgage Corporation has filed a foreclosure lawsuit in Palm Beach County Circuit Court tied to a Boca Raton home, according to court records.

The case, Freedom Mortgage Corporation v. Michael Umpierre; Gabrielle Umpierre; Countrypark at Boca Raton Homeowners’ Association, Inc., a/k/a Countrypark at Boca Raton, Inc.; and Unknown Tenant in Possession of the Subject Property, was filed December 10, 2025, in the Fifteenth Judicial Circuit, Division AH. The case number is 502025CA012835XXXAMB.

At issue is a single-family property at 8440 Red Wagon Lane, tucked inside the Countrypark at Boca Raton community, not far from Lyons Road.

In the verified complaint, Freedom Mortgage alleges that on or about May 7, 2021, defendant Michael Umpierre executed a promissory note in the principal amount of $253,950 in favor of Choice Mortgage, a Florida corporation. The loan carried interest and was secured by a mortgage on the Boca Raton property, which was recorded in the Palm Beach County public records.

The complaint states that the mortgage was later assigned to Freedom Mortgage Corporation, which claims it now holds the loan and has the right to enforce the note and mortgage. Gabrielle Umpierre is named as a defendant based on an alleged ownership interest in the property.

According to the filing, the loan went into default when required payments were not made. Freedom Mortgage alleges that the payment due July 1, 2024, and all payments after that date, were not paid. Because of that alleged default, the lender declares the full balance due under the loan documents.

The lawsuit lists the unpaid principal balance as $246,233.58, plus interest, escrow advances, taxes, insurance, and attorneys’ fees and costs, amounts the lender says are permitted under the note and mortgage. The exact total would be determined by the court if the case proceeds.

Also named in the case is Countrypark at Boca Raton Homeowners’ Association, Inc. The complaint alleges the association may claim an interest in the property through assessments or statutory liens, but that any such interest is junior and subordinate to the mortgage held by Freedom Mortgage.

An “unknown tenant in possession” is also listed as a defendant. The filing describes that party as anyone occupying the property whose interest, if any, is alleged to be inferior to the lender’s lien.

Freedom Mortgage is asking the court to determine the amounts owed, foreclose the mortgage, and order the property sold if the alleged default is not cured. The complaint also seeks to bar the defendants from any right, title, or interest in the property after a foreclosure sale, subject to Florida law.

Standard relief, but still serious.

The lender further asks the court to retain jurisdiction to issue additional orders as needed, including distributing proceeds from any sale of the property.

The complaint was verified under penalties of perjury by a representative of Freedom Mortgage Corporation. The lender is represented in the case by Miller, George & Suggs, PLLC, a Plantation-based law firm. Attorney Christian Hall is listed as counsel for the plaintiff.

The allegations outlined in the lawsuit have not been proven in court. The defendants are entitled to respond, raise defenses, or otherwise contest the claims as the case moves forward.
