BOCA RATON, FL — A child ran across the pool deck, jumped into the water and landed on a resident, according to a new civil complaint filed in Palm Beach County.
The lawsuit claims the incident happened at Suriana Boca, formerly known as Aura Boca, a residential apartment community at 789 West Yamato Road in Boca Raton.
Gina Marie Cutaia-Alvarez filed the complaint for damages on June 9, 2026, in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County. The case is styled Gina Marie Cutaia-Alvarez v. Aura Boca Owner LLC, Bozzuto Management Company, and John Doe, Serving as General Manager, Case No. 502026CA006456XXXAMB.
The complaint was filed by Brito Law Group of Coral Gables, with attorney Peter Brito listed for the plaintiff. The filing names Aura Boca Owner LLC, Bozzuto Management Company and a John Doe defendant described as the general manager on duty.
According to the complaint, Aura Boca Owner LLC and Bozzuto Management Company owned, controlled, managed or operated Suriana Boca at the time of the alleged incident.
The lawsuit says the incident happened on or about October 4, 2025, while Cutaia-Alvarez was lawfully using the community swimming pool where she resided.
According to the complaint, a child attending what the lawsuit describes as an overcrowded and unsupervised gathering ran across the pool deck and jumped into the water. The complaint claims the child landed on Cutaia-Alvarez, causing significant and permanent injuries.
The lawsuit alleges the gathering violated the property’s published amenity-area rules and created a dangerous condition at the community pool.
The complaint further claims the defendants failed to properly maintain, supervise and control the premises, failed to enforce posted occupancy and conduct rules, and failed to warn about alleged dangerous conditions.
The lawsuit brings negligence claims against Aura Boca Owner LLC, Bozzuto Management Company and the John Doe general manager. It also brings negligent selection and employment claims against Aura Boca Owner LLC and Bozzuto Management Company related to the John Doe defendant.
In the negligence counts, the complaint alleges the defendants had actual or constructive knowledge of a dangerous condition, or that the condition existed long enough that they should have known about it.
The complaint also alleges the defendants failed to properly train or supervise employees responsible for maintaining safe amenity areas at the property.
Cutaia-Alvarez claims she suffered bodily injury, pain and suffering, disability, disfigurement, mental anguish, medical expenses, lost earnings, loss of earning ability and other damages. The lawsuit says the claimed losses are permanent or continuing in nature.
The complaint seeks damages in excess of $50,000, exclusive of costs and interest. It also demands interest, costs and a jury trial.
The filing reviewed by Boca Post does not include a response from the defendants.
