BOCA RATON, FL — A demolition contractor has filed a civil lawsuit in Palm Beach County Circuit Court alleging Penn Florida Club Properties II LLC did not fully pay for work tied to a Via Mizner project in Boca Raton.
The complaint, Camino Real Group Inc. v. Penn Florida Club Properties II LLC, Case No. 502026CA006089XXXAMB, was filed May 29, 2026, in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida. The filing stamp lists the case in Division AE.
Camino Real Group Inc., which the complaint identifies as Alpha Wrecking, is represented in the filing by Conrad & Scherer LLP. The complaint names Penn Florida Club Properties II LLC as the defendant and says Penn has offices in Palm Beach County.
The claims in the lawsuit are allegations made in a civil court filing and have not been proven in court.
According to the complaint, Alpha Wrecking agreed to perform demolition services connected to a construction project at Via Mizner Golf Course & Country Club, located at 6200 Boca Del Mar Drive in Boca Raton.
The lawsuit alleges Penn and Alpha Wrecking entered into a contract for services on or about October 13, 2022. The complaint says the original contract was for $162,000.
The complaint alleges that, during the work, the parties agreed to change orders that brought the amount under the contract to $203,250. Alpha Wrecking claims it submitted invoices to Penn during the job.
According to the complaint, Penn did not object to the invoiced amounts. The lawsuit further alleges Alpha Wrecking fully performed under the contract and that its work was inspected and accepted by Penn.
Alpha Wrecking also alleges Penn never told the company that the work was being performed improperly or was otherwise unsatisfactory. The complaint claims Penn never rejected any portion of the work.
An account statement attached to the complaint is dated March 30, 2026. It lists total charges of $203,250, paid credits of $70,000 and a remaining amount due of $133,250 for the Via Mizner clubhouse project.
The complaint includes two counts: breach of contract and unjust enrichment.
In the breach of contract count, Alpha Wrecking alleges Penn materially breached the contract by not remitting full payment. The complaint claims the alleged breach caused monetary damages.
In the unjust enrichment count, Alpha Wrecking alleges it provided a benefit through demolition services, that Penn accepted or retained that benefit, and that the circumstances would make it inequitable for Penn to retain the benefit without paying fair value.
The lawsuit seeks compensatory damages, pre- and post-judgment interest, taxable costs, prevailing party attorneys’ fees as provided for in the contract, and any other relief the court deems fair and just. Alpha Wrecking also demands a jury trial.
