BOCA RATON, FL — A Palm Beach County landscaping company has filed a civil complaint against Boca Lakes Condominium Association Inc., alleging the Boca Raton condominium association owes unpaid landscaping fees after ending a service agreement, according to court records.
Fresh Start Maintenance Inc. filed the complaint on June 1, 2026, in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida. The case is Fresh Start Maintenance Inc. v. Boca Lakes Condominium Association Inc., Case No. 502026CA006078XXXAMB, assigned to Division AG.
Fresh Start is represented by Matthew M. Fischer of Matthew M. Fischer, P.A., according to the complaint. The filing states that Fresh Start and Boca Lakes are Florida corporations with principal places of business in Palm Beach County.
The lawsuit seeks monetary damages greater than $50,000, exclusive of interest, costs and attorney’s fees. The claims are allegations in a civil complaint and have not been proven in court.
According to the complaint, Boca Lakes entered into a landscaping agreement with Fresh Start on September 15, 2025, for services at property located at 8768 Chevy Chase Drive in Boca Raton.
The complaint states that the agreement had a one-year term with yearly automatic renewals unless a notice of termination was sent by certified mail at least 30 days before the renewal date. An exhibit attached to the complaint lists the 2026 landscaping maintenance price as $16,000 per month, or $192,000 annually.
Fresh Start claims the agreement included a termination provision that entitled the company to payment for work that would have been performed for the full contract term if Boca Lakes ended the agreement for convenience or without three previous written warnings supported by photographic evidence and an opportunity to cure.
The complaint alleges Boca Lakes sent Fresh Start a notice of termination on May 15, 2026. Fresh Start claims the termination was for convenience, was not mutual, and was initiated without the three prior written warnings described in the agreement.
Fresh Start alleges it provided landscaping services at the Boca Raton property from the start of the contract term through May 2026. The company claims it issued monthly invoices after providing services.
According to the lawsuit, Boca Lakes did not pay Fresh Start for services provided in May 2026. The complaint also claims Boca Lakes owes monthly fees for the remainder of the agreement’s term through September 2026.
The complaint includes two counts: breach of contract and unjust enrichment.
In the breach of contract count, Fresh Start claims Boca Lakes materially breached the written agreement by not paying as agreed. In the unjust enrichment count, which is pleaded in the alternative, Fresh Start alleges it provided landscaping services in May 2026 and that Boca Lakes retained the benefit of that work without paying compensation.
Fresh Start is seeking damages, attorney’s fees, costs and other relief the court deems proper under the contract claim. Under the unjust enrichment claim, the company seeks compensatory damages, costs and other relief.
The filing reviewed by Boca Post does not include a response from Boca Lakes Condominium Association Inc.
