Elderly Boynton Beach Woman Sues Home Depot, Claims Sexual Harassment

BOYNTON BEACH, FL (Boca Post) — An elderly woman ordered windows and doors from Home Depot for her townhome in the Platina community of Boynton Beach but she was disappointed with the final product and also that she was sexually assaulted and harassed.

A newly filed lawsuit in Palm Beach County claims that Home Depot is in breach of contract after the windows and doors Dalia Monheit, of Boynton Beach, ordered for her home were not installed properly.

After these windows were installed, they failed to properly open, thus creating a
dangerous condition at Monheit’s home.

Monheit complained numerous times to Home Depot about the installer and the
windows failing to open properly. However, Home Depot never did anything to
remedy these issues with Monheit. Home Depot never attempted to fix the windows.

As Monheit was selling her home, she was forced to hire another contractor to repair
the windows and pay that contractor $800.00 to make those repairs prior to the closing on
her home.

The lawsuit filed by Monheit’s lawyer, Daren Stabinski, of Fort Lauderdale, also claims that Home Depot violates Florida Deceptive and Unfair Trade Practices Act (FDUPTA) in its actions. Home Depot is accused of allegedly using unfair trade practices which caused Monheit to suffer a loss.

Further, the third count in the lawsuit is Assault. The lawsuit alleges that at the time of installation, the installer hired by Home Depot committed acts of sexual advances and other acts of sexual harassment against Monheit, who is an elderly woman, and caused her to suffer humiliation, fear, and mental anguish.

The statements allegedly made by the agent or employee of Home Depot were an
intentional and unlawful offer of corporal injury to Monheit, or exertion of force directed
towards Monheit, under such circumstances, as to create a reasonable fear of imminent
peril.

The original complaint does not specify what the installer allegedly said to Monheit.

As a direct and proximate result of the acts of the agent or employee, Monheit suffered
damages, including but not limited to, mental anguish and psychological harm, in the past
which will continue into the future.

Monheit is now suing Home Depot for damages including the original amount of $3,3013.15 paid to Home Depot and another $800 for the expense of the contractor she hired to fix the windows that Home Depot allegedly failed to install properly. Monheit has also incurred legal expenses which she expects Home Depot to pay for as part of the lawsuit. The lawsuit is also seeking compensatory and punitive damages for the events around this transaction.
