BOCA RATON, FL (Boca Post) (Copyright © 2026) — A domestic disturbance call at a Boca Raton apartment complex escalated into a felony arrest after police say a man threatened officers with a handgun during the investigation, according to a probable cause affidavit.
The incident happened April 13, 2026, at an apartment at 5547 N Military Trail in Boca Raton, within the jurisdiction of the Boca Raton Police Department. Officers responded shortly after 2:20 a.m. to assist on a domestic-related call already under investigation.
Ricardo J. Del Rio, 25, was identified as a subject at the scene. He was later arrested and charged with two counts of aggravated assault on a law enforcement officer, a felony under Florida Statute 784.07(2)(c), booking records show.
According to the affidavit, the situation began as Officer Glasser conducted an investigation inside the apartment. During that time, Del Rio was outside with two Boca Raton police sergeants. Officers reported hearing Del Rio yelling and directing profanity toward them in what was described as an “angry and threatening manner.”
Police say Del Rio attempted to go back inside the apartment and insisted he was no longer part of the investigation. Before entering, officers say he made obscene gestures toward one of the sergeants.
Moments later, while officers were still on scene, investigators reported hearing what sounded like the racking of a semi-automatic pistol from inside the residence. Officers immediately took cover, believing there was a risk of gunfire.
From outside the apartment, officers said they could see Del Rio through a sliding glass door holding a firearm and manipulating it in what was described as an “angry and threatening manner.” Officers then issued commands for him to exit the apartment.
Del Rio eventually came outside to the patio area, where he was taken into custody without further reported incident. A protective sweep of the apartment was conducted to ensure no one else was inside.
During that sweep, officers located a loaded Glock 19 handgun inside the residence, according to the report. The firearm was later collected as evidence.
Investigators also interviewed another individual connected to the case, who stated that Del Rio did not have permission to take the firearm and indicated it had been previously stored on a bed inside the apartment. That individual declined to pursue separate charges related to the firearm, according to the affidavit.
Based on the investigation, officers determined that Del Rio’s actions — including threatening behavior while armed and racking the firearm — created what they described as a well-founded fear of imminent violence toward the officers on scene.
Del Rio was transported to the Palm Beach County Jail following his arrest.
Jail records show he was booked at 7:19 a.m. on April 13. Bond was later set at $25,000. Court records indicate a motion for pretrial detention was filed, though a detention hearing was denied. He remains subject to conditions including no contact with the victim and restrictions on weapons.
The case is being handled through the Palm Beach County court system. A first appearance hearing was scheduled for April 14, followed by additional court dates in May and June, including an initial case conference.
