BOCA RATON, FL (Boca Post) (Copyright © 2026) — A civil complaint filed in Palm Beach County claims a resident of Boca Circle Rehabilitation Center developed worsening wounds and infections after the nursing home allegedly failed to properly plan, monitor and supervise her care.
The case, Beverly Ben-Zaken, as Next Friend of Sara Brown v. Heartland Boca Opco LLC, d/b/a Boca Circle Rehabilitation Center, was filed May 13, 2026, in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida. The case number is 502026CA005408XXXAMB.
The complaint was filed by Ford, Dean & Rotundo, P.A., which is listed as counsel for Ben-Zaken. No defense law firm is listed in the complaint.
Ben-Zaken filed the lawsuit as “next friend” of Sara Brown, who the complaint identifies as an adult resident of Palm Beach County. According to the filing, Brown was suffering from infirmities that impaired her ability to adequately provide for her own care and protection.
The defendant, Heartland Boca Opco LLC, is identified in the complaint as the licensee and owner of Boca Circle Rehabilitation Center. The complaint says the company was licensed and authorized to do business as a nursing home in Palm Beach County and was subject to Florida’s Chapter 400 nursing home laws.
According to the complaint, staff and employees at Boca Circle Rehabilitation Center failed during Brown’s residency to develop an adequate care plan and failed to properly monitor and supervise the care and treatment provided to her. The complaint claims those failures were tied to the alleged development and deterioration of wounds and infections.
The lawsuit brings a Chapter 400 claim for alleged violations of Brown’s nursing home resident rights. The complaint says the claim is based solely on custodial care issues and alleges the plaintiff complied with nursing home presuit provisions under Florida law.
The filing claims the defendant had a responsibility to provide Brown with adequate and appropriate healthcare, protective services and support services. It also claims the nursing home had a duty to comply with nursing home operating regulations and to treat residents with dignity.
The complaint alleges Boca Circle Rehabilitation Center failed in multiple ways, including failing to provide a proper turning program to prevent wounds, failing to provide a proper mattress, bedding and protective devices, failing to timely and appropriately turn and position Brown, and failing to recognize the development and worsening of wounds.
The complaint also claims the nursing home failed to adequately clean Brown to prevent skin breakdown from contact with feces and urine, failed to properly supervise her, failed to develop and update adequate care plans, failed to keep sufficient and accurate records, and failed to timely transfer her to the hospital.
According to the lawsuit, Brown suffered damages including loss of dignity, humiliation, bodily injury, pain and suffering, disability, physical impairment, disfigurement, mental anguish, inconvenience, loss of capacity to enjoy life, discomfort, aggravation of existing disease or physical defect, and medical, hospital and nursing expenses.
Ben-Zaken is seeking compensatory damages allowed by law for the alleged deprivation of Brown’s rights, along with prejudgment interest. The complaint also demands a jury trial and says the plaintiff reserves the right to later seek punitive damages.
The allegations are claims made by the plaintiff in a civil complaint and have not been proven in court.
