BOCA RATON, FL (Boca Post) (Copyright © 2026) — A Palm Beach County civil complaint filed April 17 alleges that The Encore at Boca Raton Rehabilitation and Nursing Center, LLC, doing business as The Encore at Boca Raton Rehabilitation, violated a resident’s rights under Chapter 400 of Florida law and failed to prevent and treat pressure injuries that later preceded his death.
The case, Erinn Green as Personal Representative of the Estate of David Stangoni v. The Encore at Boca Raton Rehabilitation and Nursing Center, LLC d/b/a The Encore at Boca Raton Rehabilitation, was filed in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County under Case No. 502026CA004327XXXAMB.
The plaintiff, Erinn Green, is identified in the complaint as the personal representative of the estate of David Stangoni. The complaint was e-filed April 17, 2026, and lists Morgan & Morgan as counsel for the plaintiff. No defense law firm was identified in the filing provided.
According to the complaint, Stangoni was admitted to the Boca Raton nursing home on April 9, 2024, and was free from pressure injuries on admission. The filing alleges that by April 17, 2024, an open area had been identified in his buttocks and sacrum region, and that by April 24, 2024, he had developed deep tissue pressure injuries to both heels.
The complaint claims the facility failed in multiple areas of care, including preventing pressure injuries, preventing the development of additional wounds, preventing deterioration of existing wounds, completing accurate pressure risk assessments, revising care plans, monitoring skin condition, conducting timely change-in-condition evaluations, implementing turning and repositioning schedules, carrying out incontinent care and timely offloading of the heels, and maintaining complete medical records. Those allegations have not been proven in court.
The filing says a medical note dated April 18, 2024, documented a Stage 3 pressure injury to the sacrum. It further alleges that by April 24, 2024, the sacral wound had progressed to an unstageable pressure injury with 100% eschar, and that bilateral heel injuries were also documented the same day. The complaint says Stangoni was transferred to Bethesda Hospital East on April 25, 2024, because of worsened wounds, and that hospital records described a deep sacral wound with increased drainage and odor, along with bilateral heel ulcers. It also alleges that he was re-hospitalized at JFK Hospital on April 26, 2024, with a necrotic sacral wound, poor oral intake, worsened confusion, and dysphagia.
In Count I, the plaintiff brings a Chapter 400 death claim. In Count II, the plaintiff brings a Chapter 400 survival claim. The complaint alleges that as a direct and proximate result of the defendant’s acts and omissions, David Stangoni died on May 4, 2024. It identifies the estate and Erinn Green, his spouse, as wrongful death beneficiaries and seeks damages exceeding $50,000, along with costs, interest, and a jury trial. Those are claims made by the plaintiff and have not been adjudicated.
