BOCA RATON, FL — A roofing contractor has filed a civil complaint in Palm Beach County Circuit Court over an alleged unpaid balance tied to Phase II of Alina Residences in Boca Raton, according to court records.
The lawsuit, Aderhold Roofing Corporation v. Moss & Associates, LLC and Travelers Casualty and Surety Company of America, was filed June 19, 2026, in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County. The case is listed as Case No. 50-2026-CA-006883-XXXX-MB, Division AO.
Aderhold Roofing Corporation, a Florida corporation with its principal place of business in Tampa, is the plaintiff. The complaint names Moss & Associates, LLC, a Florida limited liability company based in Fort Lauderdale, and Travelers Casualty and Surety Company of America, a Connecticut corporation, as defendants.
The complaint was filed by Lee E. Tomlinson and Virgil Tray Batcher of Adams & Reese, LLP, according to the filing. The claims in the complaint are allegations and have not been proven in court.
According to the complaint, non-party El-Ad Mizner on the Green II, LLC owns the real property located at 210-220 SE Mizer Boulevard in Boca Raton. The filing says El-Ad Mizner retained Moss to construct 182 condominium units and a 353-space parking garage at the property, which the complaint identifies as Phase II - Alina Residences.
The lawsuit alleges Moss retained Aderhold to furnish labor, services and materials for roof installation and related construction at the project. The complaint states that the contract between Moss and Aderhold, including amendments and change orders, is attached to the filing.
According to the complaint, Aderhold was to furnish and install roofing and related construction in exchange for payment of approximately $1,953,627.36. The filing alleges Aderhold fulfilled its obligations under the contract.
Aderhold claims Moss has not remitted $141,326.12, including $87,143.50 in unpaid retainage, according to the complaint. The lawsuit further alleges that the unpaid amount is due for labor and materials provided by Aderhold and incorporated into improvements constructed as part of the Boca Raton project.
The complaint says Aderhold first furnished labor and materials to the project on May 15, 2023, and last furnished labor and materials on June 20, 2025. The filing states that Aderhold served a Notice of Non-Payment on Moss and Travelers on January 28, 2026.
The lawsuit describes the case as an action against a payment bond. According to the complaint, Moss is the principal on the bond and Travelers is the surety on the bond connected to the project.
Aderhold is seeking a judgment against Moss and Travelers for $141,326.12, plus interest, attorneys’ fees, court costs and other relief the court deems proper, according to the complaint. The filing says the action seeks damages in excess of $50,000.
The complaint included in the filing reviewed by Boca Post does not include a response from Moss or Travelers.
