BOCA RATON, FL (Boca Post) (Copyright © 2026) — A Boca Raton commercial landlord has filed a civil complaint in Palm Beach County Circuit Court alleging a tenant defaulted on its lease, failed to pay rent, and abandoned a business space on Rogers Circle.

The case, Boca Business Center Developers, LLC v. Carbonatik, LLC and Joseph K. Swaminathan a/k/a Joseph Kamalesh, Case No. 502026CA004876XXXAMB, was filed April 30, 2026 in the 15th Judicial Circuit in and for Palm Beach County, Florida. The plaintiff is represented by Boca Raton-based law firm Warren & Grant, P.A., according to the filing.

According to the complaint, Boca Business Center Developers, LLC owns commercial property at 1181 S. Rogers Circle, Suite 24, in Boca Raton. The company alleges it entered into a lease agreement with Carbonatik, LLC on or about June 6, 2024, with Joseph K. Swaminathan signing a personal guaranty tied to the lease obligations.

The lease term was set to run through approximately June 30, 2028, and required the tenant to make monthly rent payments along with applicable taxes and other charges. The complaint claims the tenant began failing to meet those obligations on or about July 1, 2025, and continued to miss payments thereafter.

The landlord alleges that those missed payments constitute a material breach of the lease. It further claims that on April 13, 2026, the tenant was served with a notice of monetary default and a demand to pay rent or surrender possession of the premises.

According to the filing, the tenant did not cure the default. The complaint states that by April 27, 2026, the tenant had allegedly abandoned the premises and ceased operating its business there. The landlord says it retook possession of the property on or about that date and also issued a notice of non-monetary default for abandonment.

The lawsuit alleges that despite retaking possession, the lease obligations remain in effect and that the tenant has failed to comply with the terms of the agreement. The landlord claims damages exceeding $50,000, including unpaid rent, additional charges, and accelerated rent for the remainder of the lease term.

In a separate count, the complaint alleges that Swaminathan, as guarantor, is jointly and severally liable for the tenant’s obligations under the lease. The landlord claims the guarantor has failed to pay amounts due despite the tenant’s alleged default, constituting a breach of the guaranty agreement.

The plaintiff is seeking damages in excess of $50,000, along with court costs, attorneys’ fees, and other relief the court deems appropriate.

All allegations are claims made by the plaintiff and have not been proven in court.
