Boca Commerce Park Landlord Files Eviction Complaint Against Upholstery Tenant

A civil complaint filed in Palm Beach County Circuit Court seeks to evict a Boca Raton furniture upholstery tenant from Boca Commerce Park and pursue damages against the company and its personal guarantor, according to the lawsuit.

BOCA RATON, FL — A commercial landlord has filed a civil eviction complaint in Palm Beach County Circuit Court against a Boca Raton furniture upholstery company and the individual who personally guaranteed its lease, according to the newly filed lawsuit.

The complaint, PSB Boca Commerce Park, LLC v. Jimenez Camilo Inc. and Zoraya Camilo, was filed on July 6, 2026 in the 15th Judicial Circuit in and for Palm Beach County, Florida. The case was assigned to Division AH under Case No. 502026CA007549XXXAMB, court records show. The plaintiff is represented by Peter L. Meltzer of Frank, Weinberg & Black, P.L., a Plantation-based firm.

The lawsuit concerns commercial space at 10050 Spanish Isles Blvd., Suite E1, in the Boca Commerce Park property in Boca Raton, according to the complaint. The filing states the parties entered into a written lease for the 1,310-square-foot warehouse and office space on or about March 7, 2025, with a term running through March 31, 2028.

According to the complaint, the tenant defaulted under the lease by failing to stay current on rent. The filing alleges that in response to the payment default, and pursuant to Fla. Stat. §83.20, the landlord delivered a three-day notice to the tenant and guarantor on June 22, 2026, seeking possession of the premises or payment of past-due rent. The complaint alleges the defendants failed to tender the rent and the tenant failed to vacate within the required time.

The complaint states that Zoraya Camilo executed a written personal guaranty of the lease. The lawsuit alleges she is jointly and severally liable with Jimenez Camilo Inc. for the rent obligations under the lease.

The complaint brings three counts: eviction under Fla. Stat. §83.21 and the summary procedures of Fla. Stat. §51.011; breach of lease for damages against Jimenez Camilo Inc.; and action on the guaranty for damages against Zoraya Camilo.

The lawsuit seeks a final judgment of eviction against Jimenez Camilo Inc. and the issuance of a writ of possession removing the tenant from the premises, according to the complaint. On the damages counts, the filing seeks unpaid rent, attorney's fees and costs, pre-judgment interest under the lease and Fla. Stat. §83.251, and any other relief the court deems just and proper. The complaint states the damages sought exceed $50,000, exclusive of interest, costs, and attorney's fees.

The rent figure alleged in the body of the complaint and the figure listed in the attached three-day notice do not match. Paragraph 17 of the complaint alleges the defendants owe the landlord, jointly and severally, $15,470.32 in past-due rent through July 2025. The three-day notice attached as an exhibit to the complaint, dated June 22, 2026, states the defendants were indebted for $10,922.94 in past-due rent through June 2026. The filing does not reconcile the two figures.

The lease exhibit attached to the complaint lists the permitted use of the premises as warehouse and office space for a furniture upholstery company.

The filing reviewed by Boca Post does not include a response from the defendants, and no defense counsel is listed in the reviewed filing. The complaint does not include a demand for jury trial and proceeds under the summary procedures for commercial eviction actions.

The case remains newly filed and pending in Palm Beach County Circuit Court, with no hearing date listed in the reviewed record.
