WELLINGTON, FL (Boca Post) (Copyright © 2025) — VillageWalk of Wellington Homeowners Association, Inc. has filed two separate civil lawsuits in Palm Beach County Circuit Court seeking foreclosure and monetary damages against homeowners within the same Wellington community, according to court records.

Both cases were filed on December 18, 2025, in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida. Each lawsuit alleges unpaid homeowners association assessments and related charges secured by recorded claims of lien.

Case One: VillageWalk of Wellington HOA v. Haiyan Liu

In the first action, VillageWalk of Wellington Homeowners Association, Inc. v. Haiyan Liu, Case No. 502025CA013174XXXAMB (Division AD), the association alleges that Liu is the record owner of a home located at 3124 Ushant Court, Wellington, identified as Lot 954 of VillageWalk of Wellington – Plat Five.

According to the complaint, Liu took title to the property subject to the community’s recorded Declaration of Covenants, Conditions, and Restrictions, making her a member of the association and responsible for regular and special assessments. The HOA alleges that certain assessments were not paid when due.

The complaint states that the association issued statutory notices, including a 30-day late notice and a demand for payment with notice of intent to lien. After payment was allegedly not made, the association recorded a claim of lien on October 10, 2025, in the Palm Beach County public records.

As of the lien filing, the HOA alleges unpaid assessments totaling $5,262.00, plus interest, late fees, costs, and attorneys’ fees, with additional amounts continuing to accrue. The lawsuit seeks foreclosure of the lien, recovery of damages, interest, costs, and attorneys’ fees, and possession of the property if foreclosure proceeds.

Case Two: VillageWalk of Wellington HOA v. Bei Chen

In a separate but similar action, VillageWalk of Wellington Homeowners Association, Inc. v. Bei Chen, Case No. 502025CA013161XXXAMB (Division AH), the association brings nearly identical claims involving a different property within the same community.

According to the complaint, Chen is the record owner of a home located at 8397 Xanthus Lane, Wellington, identified as Lot 557 of VillageWalk of Wellington – Plat Four. The association alleges Chen is likewise bound by the Declaration governing the community and responsible for assessments levied for common expenses.

The HOA claims that regular and/or special assessments were not paid in full and that required statutory notices were sent. A claim of lien was recorded on October 10, 2025, also in the Palm Beach County public records.

In this case, the association alleges that $5,091.00 in unpaid assessments was due as of the lien filing, exclusive of interest, late fees, costs, and attorneys’ fees that continue to accrue. As with the Liu case, the HOA seeks foreclosure of the lien, a money judgment for damages, recovery of fees and costs, and possession of the property if foreclosure occurs.

Court Status

Both lawsuits are civil foreclosure actions combined with claims for monetary damages. The allegations have not been proven in court. No final judgments have been entered in either case as of the filing date.
