BOCA RATON, FL (Boca Post) — Gustavo De Lucca of Boca Raton has been arrested and charged with grand theft after shoplifting a $2,400 figurine from Neiman Marcus.

Gustavo De Lucca, 19, of the 20000 block of Uptown ave in Boca Raton, has been arrested by the Boca Raton Police Department following a shoplifting incident at the Neiman Marcus located in Town Center at Boca Raton. Boca Post has been notified that the charge filed is grand theft due to the dollar amount of the merchandise.

According to the Boca Raton Police Department, De Lucca was in the custody of Neiman Marcus Loss Prevention personnel when they responded to the call for service. The arresting officer reports the incident:

On Tuesday, August 16, 2022, at 1551 hours, I was dispatched to Neiman Marcus located at 5860 W Glades Rd in the City of Boca Raton in reference to a shoplifter in custody. Upon my arrival, I met with a loss prevention employee who advised of the following in a sworn written statement:

The loss prevention employee stated that on the above date at 1517 hours, he first observed the suspect, later identified by Florida license as Gustavo De Lucca enter the store’s second-floor display section. The loss prevention employee witnessed De Lucca select a Jay Strongwater tiger figurine (Value: $2,400.00) and immediately conceal it within a shopping bag. Visual surveillance was maintained as De Lucca returned to the first floor and began walking towards the store’s interior mall entrance. The loss prevention employee witnessed De Lucea pass all points of sale without attempting payment. After De Lucca exited the store, the loss prevention employee apprehended him, recovered the stolen item, and escorted De Lucca back to the loss prevention office. The loss prevention employee showed me video footage of the incident which accurately depicts the events as described.

I then met with De Lucca in the loss prevention office. I read De Lucca his Miranda Warnings from a pre-printed card which he stated he understood. De Lucca stated that no matter what he said to me he knew he was going to jail and did not wish to speak about the incident.

Based upon the above investigation including video footage and sworn statement, probable cause was established and De Lucca was placed under arrest for one (1) count of Grand Theft Under $5,000 pursuant to F.S.S. 812.014(2C1). I placed De Lucca in handcuffs which were double locked after checking for tightness. I transported De Lucca to BRPD for processing and he was later transported to the Palm Beach County Jail. No further involvement.

Gustavo De Lucca was booked into the Palm Beach County Jail at 7:30 PM on Wednesday, August 16th, 2022. De Lucca was released the following day without bond after the $3,000 mandatory bond was removed by a judge.

Gustavo De Lucca was ordered to stay away from Neiman Marcus. Shoplifters are usually also trespassed from the entire mall property, per policy.
