Lawsuit Claims Nicolas Quintero Fell Out Of Stretcher Due To West Palm Beach Fire Rescue'S Negligence

WEST PALM BEACH, FL (Boca Post) — In a world where anyone can sue anyone for literally anything, a West Palm Beach man is suing the City of West Palm Beach because of an incident where he fell out of a stretcher when being transported by the city’s fire department.

According to the newly filed lawsuit in Palm Beach County, Nicolas Quintero, a West Palm Beach resident, called 911 for help on May 12, 2021. The complaint was nerve pain on the left side of his body that he suffered from for two weeks. According to the lawsuit Quintero fell out of the stretcher while being transported by WPBFD.

According to the lawsuit, while attempting to transfer Quintero by stretcher, the stretcher tipped and Quintero fell due to the negligence of the City’s employees. As a result of the City’s negligence, Quintero sustained injuries and damages.

The lawsuit claims that the City owed a duty to Quintero to exercise reasonable
and ordinary care in the performance of paramedic/EMTduties including, but not limited to,
transferring and securing Quintero.

The Quintero was negligent and breached its duty of reasonable care for the
safety and protection of the Plaintiff in all or more of the following ways:

  • Failing to properly secure Plaintiff to the stretcher.
  • Failing to properly maintain the stretcher.
  • Failing to properly use the safety straps and/or side rails.
  • Failing to properly load Plaintiff.
  • Failing to properly transfer Plaintiff.

The lawsuit claims that due to this incident, Quintero suffered in the past and will suffer in the future bodily injury and resulting pain and suffering, disability, scarring and disfigurement, mental anguish, inconvenience, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment and aggravation of preexisting conditions.
