Boca Lago Condo Association Sues Estate Over Unpaid Assessments

BOCA RATON, FL (Boca Post) (Copyright © 2025) — Horizons of Boca Lago Condominium Association, Inc. has filed a civil action in Palm Beach County seeking to foreclose on a unit and recover unpaid assessments, late fees, and other charges allegedly owed by the Estate of Lisa Lindner.

The complaint, filed November 24, 2025, is captioned Horizons of Boca Lago Condominium Association, Inc. v. Unknown Heirs, Devisees, Grantees, Assignees, Lienors, Creditors, Trustees and/or Other Claimants Claiming by, Through, Under or Against Lisa Lindner, Deceased; Susan L. Schaaf; and Unknown Party or Parties in Possession (Case No. 502025CA012235XXXAMB).

The lawsuit was filed in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida. According to the complaint, the Association alleges that Lindner—identified as the former owner of the unit—failed to pay required monthly condominium assessments within the time periods set by the governing documents. The filing states that the defendant estate, through its representative, Susan L. Schaaf, may claim some right or interest in the property, but that any such claim is subordinate to the Association’s lien rights.

The complaint includes two counts. Count I seeks foreclosure of the Association’s lien. The Association alleges it recorded a claim of lien after assessments became delinquent, asserting that all conditions precedent to filing the action have been met. It asks the court to determine the amount owed, foreclose the claim of lien, and authorize a clerk’s sale of the property should the debt remain unpaid. It also seeks a deficiency judgment for any remaining balance following the sale.

An attached Claim of Lien for Assessments, dated August 13, 2025, details the amounts the Association claims remained outstanding at that time. The exhibit lists unpaid monthly assessments for early 2025, roof special assessments, interest, late charges, and related fees, totaling several hundred dollars in principal plus accruing charges. The document is signed by Arthur E. Lewis as agent for the Association and notarized the same day.

Count II of the complaint seeks a money judgment for all assessments, late fees, collection costs, and reasonable attorneys’ fees related to the alleged delinquency. The Association states that because the estate has not paid the amounts owed, it is entitled to a judgment for damages in addition to any equitable foreclosure relief.

The filing identifies Poliakoff Backer, LLP, located on North Federal Highway in Boca Raton, as counsel for the plaintiff Association. Attorney Arthur E. Lewis signed the complaint on behalf of the firm.

As with all civil complaints, the assertions in the document are allegations, not findings of fact. No response from the defendants had been filed at the time of the complaint’s submission, and no judicial determinations have been made as to the validity of the Association’s claims.
