BOYNTON BEACH, FL (Boca Post) (Copyright © 2026) — A civil lawsuit alleging negligence and wrongful death has been filed in Palm Beach County Circuit Court against Superhero Kids PPEC, LLC, a company the complaint says operated a daycare facility for medically complex children in Boynton Beach.
The complaint was filed Feb. 3, 2026, in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida, under case number 502026CA001246XXXAMB, listing Melinda Potts, as personal representative of the Estate of B.L., a minor, v. Superhero Kids PPEC, LLC.
Potts is represented by The Law Offices of Berman & Berman, P.A. of Boca Raton, according to the filing. A defense law firm was not listed in the complaint provided.
The lawsuit seeks damages in excess of $50,000, exclusive of costs, interest, and attorneys’ fees, and demands a jury trial. The allegations have not been proven in court.
According to the complaint, the case stems from events alleged to have occurred on July 1, 2024, when the child identified as B.L. was at Superhero Kids’ facility. The complaint describes Superhero Kids as operating a daycare facility “specifically for children with medically complex conditions” at 1700 Woolbright Rd., Suite 3, Boynton Beach, and says the incident giving rise to the lawsuit occurred in Palm Beach County.
The complaint alleges that on the morning of July 1, 2024, a bus owned and operated by Superhero Kids picked up B.L., described as 22 months old, from the plaintiff’s residence at about 8:30 a.m. and transported the child to the facility.
The complaint further alleges the child “was born premature” and had “a hole in her heart,” and required “a tracheostomy with supplemental oxygen.” It claims Superhero Kids and its staff knew or should have known the child required “continuous and uninterrupted supervision and monitoring” while at the facility.
The lawsuit alleges Superhero Kids failed to properly supervise and monitor the child for an extended period and failed to call for medical attention when the child’s condition was allegedly deteriorating. It also claims staff did not contact the child’s parents or emergency services. The complaint alleges that by the time the child was brought home at the end of the day, the child had been without sufficient oxygen for a prolonged period, and that the child died on July 1, 2024 as a result of the alleged acts and omissions.
In a single negligence count, the complaint alleges Superhero Kids owed duties to operate the facility in a reasonable and prudent manner and to exercise reasonable care for the child’s health and safety given the child’s physical condition. It also alleges the company had a duty to provide appropriate supervision, including compliance with applicable regulations, and lists alleged failures including establishing and implementing a proper supervision plan, monitoring and responding to medical needs, training and supervising staff, following policies and procedures, recognizing medical distress, and responding to that distress.
The complaint seeks damages allowed under Florida’s Wrongful Death Act, the filing states.
