BOCA RATON, FL (Boca Post) (Copyright © 2026) — A Palm Beach County man has filed a civil lawsuit claiming he was injured after stepping on a sharp object inside a pool at Beach Club at The Boca Raton.

The complaint, Ernest Davidson v. Boca Owner, LLC d/b/a Beach Club At The Boca Raton, Resort Hotel Purchasing Group, Inc., and One Stop Pool Pros, Inc., was filed May 11, 2026, in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida, General Jurisdiction Division. The case number is 502026CA005295XXXAMB.

Davidson is represented by Scott Merl, P.A., of Coral Gables, according to the complaint. No defense law firm is listed in the filing.

The lawsuit names Boca Owner, LLC, described in the complaint as a foreign limited liability company doing business as Beach Club at The Boca Raton; Resort Hotel Purchasing Group, Inc., described as a Vermont corporation; and One Stop Pool Pros, Inc., described as a Florida profit corporation. The allegations are claims made by the plaintiff and have not been proven in court.

According to the complaint, the case stems from an incident on or about May 15, 2022, at 900 S. Ocean Blvd. in Boca Raton. Davidson claims he was lawfully in the pool on the premises when he stepped on a sharp object inside the pool, injuring his toe.

The complaint alleges the pool was poorly maintained, creating what Davidson describes as a dangerous condition. He claims the condition made it foreseeable that someone using the pool could step on a sharp object and be injured.

Davidson brings separate negligence counts against Boca Owner, LLC d/b/a Beach Club at The Boca Raton, Resort Hotel Purchasing Group, Inc., and One Stop Pool Pros, Inc. In each count, the complaint claims the defendant owned, managed, controlled, operated, maintained and/or possessed the property at the time.

The lawsuit alleges the defendants owed Davidson a duty to keep the premises in a reasonably safe condition and to warn invitees of any dangerous condition. It further claims the defendants knew or should have known about the condition through reasonable care and inspection because the condition was allegedly created by the defendants.

Among the alleged failures listed in the complaint are failing to maintain the premises, failing to inspect the premises, failing to warn of the condition, and failing to correct the condition. The filing also includes language alleging the improper height of a rug in the lobby, though the incident described in the complaint concerns Davidson stepping on a sharp object inside the pool.

Davidson claims he suffered bodily injuries, pain and suffering, disability, disfigurement, scarring, mental anguish, loss of enjoyment of life, medical expenses, lost earnings, loss of ability to earn money, and aggravation of a previously existing condition. The complaint states that the losses are either permanent or continuing.

The lawsuit seeks damages in excess of $50,000, excluding interest and costs. Davidson also demands a jury trial on all issues triable by law.
