BOCA RATON, FL (Boca Post) (Copyright © 2026) — A Broward County woman has filed a civil complaint against the operator of Joseph’s Classic Market in Boca Raton, claiming she was injured after tripping over a stack of baskets near the store entrance.
The lawsuit, Marcia Nijamkin v. Boca Food Market LLC, Case No. 502026CA005372XXXAMB, was filed May 12, 2026, in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida. Boca Food Market LLC is identified in the complaint as the operator of Joseph’s Classic Market, located at 6000 Glades Road in Boca Raton.
The plaintiff, Marcia Nijamkin, is represented by Chalik & Chalik, P.A., according to the filing. No defense law firm is listed in the complaint.
The complaint says Boca Food Market LLC, doing business as Joseph’s Classic Market, owned, operated, maintained or controlled the business premises at the time of the alleged incident. It also says the company was licensed to do business in Florida and operated the store in Palm Beach County.
According to the complaint, Nijamkin was a business invitee at Joseph’s Classic Market on or about Aug. 17, 2025. The filing claims the store owed customers, including Nijamkin, a duty to keep the premises in a reasonably safe condition.
The complaint alleges Boca Food Market LLC breached that duty by creating, or allowing to be created, a dangerous and defective condition at the entrance of the store. The filing identifies that condition as a stack of baskets that was allegedly placed negligently near the entrance.
Nijamkin claims the basket stack caused her to trip and fall, injuring herself.
The complaint further alleges Boca Food Market LLC knew or should have known about the condition. It claims the company failed to warn customers, including Nijamkin, or allowed the condition to remain long enough that a reasonable inspection would have revealed it.
The filing says Nijamkin suffered injuries to her body and extremities. It also claims she suffered physical handicap, aggravation of a pre-existing condition, physical and mental pain and suffering, permanent disability and disfigurement, medical and maintenance expenses, and wage loss.
According to the complaint, those alleged injuries and losses are either permanent or continuing in nature, and Nijamkin claims she will continue to suffer losses and impairments in the future.
Nijamkin is seeking damages in excess of $50,000, exclusive of interest and costs. The complaint also demands a jury trial on all issues that may be tried by jury.
