BOYNTON BEACH, FL (Boca Post) — Thomas Danks of Boynton Beach has been arrested and charged with DUI and fleeing police, according to jail records released to Boca Post by the Palm Beach County Sheriff’s Office.

Thomas Danks, 62, of The Belmont in Boynton Beach, has been arrested by the Palm Beach Sheriff’s Office. Boca Post has been notified that the charges filed include DUI and Fleeing/Eluding police.

According to an arrest affidavit submitted by the Palm Beach Sheriff’s Office, deputies tried to pull Danks over for a broken tail light when he refused to pull over.

The deputy reports:

On August 26th, 2022 at approximately 10:02 pm while performing the duties of a Palm Beach County Sheriff’s Deputy; I was on Boynton Beach Blvd/Quail Covey Road conducting speed enforcement. During this time, I observed a silver vehicle traveling east on Boynton Beach Blvd with no tail lights on. As I attempted to catch up to the vehicle, it made a right turn onto Knuth Road. Once I got behind the vehicle, the taillights were still not activated. I activated my emergency equipment (lights) to attempt a traffic stop. The vehicle continued to travel south on Knuth Road at speeds of 30 miles per hour while on the yellow line. I activated my sirens but the vehicle continued traveling south at the same speed. It then turned left into a community all while my lights/sirens were activated and continued to drive through the community making multiple turns. After traveling roughly a half mile from the time my emergency equipment was activated, the vehicle finally came to a stop at 2102 Belmont Place (owner of vehicle address).

The driver immediately exited the vehicle upon stopping. During that time I observed food on his clothes and wi his eyes were bloodshot/watery. I asked what took him so long to stop and he stated he don’t know. When I brought attention to the stains on his shirt, he was unaware. After asking the driver where he was coming from, he was unable to answer. He was asked if he used any drugs or took medication/have medical issues and he stated no. When asked how much drank tonight, he stated a couple of drinks. After being asked to explain how much couples, he stated “3 beers”. While speaking with the driver I noticed him swaying and he had a strong odor of an unknown alcoholic beverage emitting from him. I asked him for his driver’s license and he provided me a Florida DL where I was able to identify him as Thomas Danks.

Based on my suspicion that Thomas was under the influence, I asked him if he would consent to perform Standardized Field Sobriety Evaluations (SFSTs) for the purpose of determining if he was impaired while operating a motor vehicle. Thomas asked if he had to perform them. I advised him of Taylor’s Warnings, informing him that the SFSTS were voluntary and he did not have to perform them. I then explained in the absence of his performance I would be only left with the physical evidence of impairment before me which could be a strong basis for being placed under arrest for DUI. Thomas asked what the task consisted of and I explained them.

Both Taylor’s Warnings and the task were explained several times after Thomas repeatedly asked about them after they were explained. Thomas also consistently stated that he is at home and he can just go into the house. I explained to him that I observed him commit a violation while on Boynton Beach Blvd. He also did not recall the violation he committed after it was explained.

Due to the totality of circumstances, at approximately 10:25 am, Thomas was placed under arrest for driving under the influence. His cuffs were double-locked and checked for proper fit. Thomas then stated he is now willing to perform the exercises. I explained to him he is now arrested. I then transported him to the Palm Beach County Sheriff’s Office BAT center without incident. At approximately 11:25 pm, we arrived at the BATcenter and the 20-minute observation period began under my supervision. At approximately 11:49 pm, Thomaswasaskedif he would provide a breath sample. He asked what he doesn’t. Implied consent was read in which he stated he understood and would provide the sample. The highest of the 3 samples provided was .183.

Thomas was read his Miranda rights and he chose not to speak. His vehicle was towed by Zuccalas Towing. He was booked into the county jail.

Thomas Danks was booked into the Palm Beach County Jail at 2:14 on Saturday morning. Danks was later released from jail after posting a $6,000 bond. Danks has since pleaded not guilty to all charges.

According to the Florida Department of Business and Professional Regulation, Thomas Danks holds a current sales associate real estate license. Thomas Danks appears to have been associated with Keller Williams; however, the KW.com website no longer includes his information.
