Ride Scare – Florida Woman Sues Lyft After Being Dragged By Car

PALM BEACH COUNTY, FL – Boca Post (BocaPost.com) — A Lake Park woman is suing Lyft as well as the driver that was supposed to give her a ride in the car but instead ended up dragging her alongside it, according to a new lawsuit filed in Palm Beach County.

On December 30, 2019, Gay Marlin called for a Lyft ride to be picked up from 873 Lake Shore Drive in Lake Park, Palm Beach County, Florida. The driver, Lia Echeverrieta, showed up to pick Marlin up.

While Marlin was entering the vehicle, Echeverrieta accelerated and drove away before Marlin was able to fully get into the vehicle, causing Marlin to be dragged along the ground which caused her serious and permanent injuries.

The lawsuit claims that Echeverrieta was negligent by failing to operate her motor vehicle in a safe and reasonable manner, failing to keep a proper lookout, and failing to not move the vehicle she was operating until Marlin was inside, seated in the vehicle and the door was closed.

According to the lawsuit, it is those actions that caused Marlin to fall halfway inside the car where she was holding onto the door and the lower half of her body was hanging out of the car where she was dragged on the ground and then dragged alongside the vehicle causing serious injuries to Marlin.

This incident raises so many questions. Are these rideshare drivers in such a hurry that they are not considering the safety of the passengers? Are the rideshare companies at fault for putting the drivers under so much pressure?

The lawsuit claims vicarious liability against Lyft.

According to the suit, Lyft is responsible and vicariously liable for the negligence
of its employee or agent who breached her duties of care to Marlin by failing to operate her 2012 Honda Civic in a safe and reasonable manner.

The suit claims that Marlin suffered bodily injuries and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expense of hospitalization, medical care, nursing care, treatment, cost of rehabilitation, loss of income in the past and in the future, and aggravation of a previously existing condition. These losses are either permanent or continuing in nature, and Marlin will continue to suffer losses in the future.

David Gaspari of The Law Offices Of David M. Gaspari, P.A. is representing Gay Marlin in seeking damages from Lyft and the Lyft driver for this incident.
