PALM BEACH GARDENS, FL — A California Pizza Kitchen restaurant in Palm Beach Gardens is facing a civil lawsuit in Palm Beach County after a customer with celiac disease alleged that the restaurant served her a regular, gluten-containing pizza in place of the gluten-free pizza she ordered, according to a complaint filed this month in circuit court.
Victoria Ramdeholl and her husband, Erick Ramdeholl, filed the lawsuit against California Pizza Kitchen, Inc. on July 15, 2026, in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida. The lawsuit alleges that shortly after eating the pizza, Ramdeholl developed a severe allergic and mast cell reaction that included shortness of breath, shallow breathing, and bumps on the roof of her mouth and tongue. According to the complaint, she required emergency care and was taken to Jupiter Medical Center, where she received intravenous medication and fluids. The filing claims the gluten exposure aggravated her preexisting conditions and caused ongoing symptoms requiring continuing care.
The complaint brings three counts against California Pizza Kitchen. The first count alleges negligence, claiming the restaurant owed a duty to prepare and serve the designated gluten-free order with reasonable care and breached that duty. The second count alleges breach of the implied warranties of merchantability and fitness for a particular purpose under Florida's Uniform Commercial Code, claiming the food did not conform to what was ordered. The third count, brought by Erick Ramdeholl, alleges loss of consortium, claiming he lost his wife's companionship, society, comfort, and services as a result of her injuries.
The complaint states the action involves damages in excess of $50,000, exclusive of interest, costs, and attorney's fees.
