DAVIE, FL — A Broward County motorcyclist has filed a civil lawsuit in Broward County Circuit Court accusing a driver of negligently operating a BMW SUV that allegedly collided with his motorcycle in Davie, according to a complaint filed Monday.
Jason Berthier Fortin sued Robert Macias on June 29, 2026, in the Seventeenth Judicial Circuit in and for Broward County, Florida. Court records show the case was assigned to Division 13 under Case No. CACE-26-010591. The complaint was electronically filed at 9:49 a.m. through the Broward County Clerk of Courts.
Fortin is represented by Chezky Rodal of Morgan & Morgan, P.A., based in Plantation, according to the complaint. The filing reviewed by Boca Post does not include a response from the defendant.
According to the complaint, Fortin was riding a motorcycle in Davie on or about May 2, 2026, when Macias, who was operating a 2019 white BMW X3 at the same time and place, allegedly collided with the motorcycle. The lawsuit alleges Macias negligently operated and maintained the BMW so that it collided with Fortin's motorcycle.
The single-count complaint brings a motor vehicle negligence claim against Macias. The lawsuit alleges Macias owed Fortin a duty to operate his vehicle in a safe, careful and prudent manner so as not to collide with the motorcycle, and that he breached that duty by carelessly and negligently operating the BMW.
The complaint alleges Fortin suffered bodily injury including a permanent injury to the body as a whole, pain and suffering of both a physical and mental nature, disability, physical impairment, disfigurement and mental anguish as a direct and proximate result of the alleged negligence. The filing also claims Fortin experienced inconvenience, activation of a latent condition, loss of capacity for the enjoyment of life and aggravation of an existing condition.
According to the complaint, Fortin has incurred expenses for hospitalization, medical and nursing care and treatment, and has sustained losses of earnings and the ability to earn money. The lawsuit alleges the losses are either permanent or continuing and that Fortin will continue to suffer them in the future. The complaint also states that Fortin's motorcycle was damaged in the crash.
The lawsuit seeks damages that exceed $50,000, exclusive of costs, interest and attorneys' fees, the minimum jurisdictional threshold required for the circuit court. The complaint states the actual value of the claim will be determined by a jury under Article 1, Section 21 of the Florida Constitution. Fortin demanded a jury trial on all issues so triable.
The complaint asserts that venue is proper in Broward County under Florida Statute 47.011 because the crash giving rise to the action occurred in the county. Both Fortin and Macias are identified in the filing as natural persons residing in Broward County.
