DELRAY BEACH, FL (Boca Post) (Copyright © 2026) — A Delray Beach synagogue has filed a civil complaint in Palm Beach County Court accusing another local nonprofit of failing to pay for property damage tied to a short-term occupancy agreement earlier this year.

The case, Oriole Jewish Center of Delray Beach Anshei Shalom, Inc. v. Cheder Chabad, Inc., was filed July 8, 2025, in the County Court of the 15th Judicial Circuit in and for Palm Beach County. The case is assigned Case No. 50-2025-CC-010615-XXX-ASB and seeks damages not exceeding $50,000. The plaintiff is represented by Gerstin & Associates, according to the complaint.

According to the complaint, both the plaintiff and defendant are not-for-profit corporations operating in Palm Beach County. The dispute centers on a written agreement entered into on or about February 3, 2025, concerning the defendant’s occupancy of property located at 7099 West Atlantic Avenue in Delray Beach.

The plaintiff alleges the agreement required the defendant to repair any damage caused during its occupancy. The defendant vacated the property in mid-February 2025, and a walkthrough inspection was conducted with both parties present.

During that inspection, the complaint claims the defendant acknowledged responsibility for damage to the property and signed a written document itemizing those issues.

The plaintiff further alleges it obtained contractor estimates totaling $40,189.95 to repair the damage. When attorney’s fees and related costs are included, the total amount claimed rises to $41,789.95.

According to the complaint, the plaintiff made formal demands for payment on or about April 3, 2025, and again in a letter dated May 20, 2025. The defendant is accused of failing and refusing to make any payment.

The lawsuit alleges breach of contract, stating the agreement constituted a valid and enforceable contract between the parties. The plaintiff claims the defendant materially breached that agreement by failing to repair damage and reimburse costs associated with those repairs and legal fees.

As a result, the plaintiff claims it has suffered damages totaling $41,789.95 and has been required to retain legal counsel to pursue recovery.

The complaint seeks a judgment in that amount, along with attorney’s fees, court costs, and any additional relief the court deems appropriate.
