LAKE PARK, FL (Boca Post) (Copyright © 2026) — A Palm Beach County civil complaint filed March 26, 2026, alleges that Alice Maldonado was injured while shopping at a Home Depot store in Lake Park and is seeking damages from Home Depot U.S.A., Inc.
The case, Alice Maldonado v. Home Depot U.S.A., Inc., was filed in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida, under Case No. 502026CA003414XXXAMB.
The complaint says the claim exceeds $50,000, exclusive of costs, interest, and attorneys’ fees. Attorney Byron T. Jackson of Morgan & Morgan signed the filing on behalf of the plaintiff. No defense law firm is listed in the complaint.
According to the complaint, Home Depot U.S.A., Inc. owned and operated the retail store at 3860 Northlake Blvd. in Lake Park, and the premises were open to the general public, including Maldonado. The filing says Maldonado was at the store on or about Oct. 16, 2025, as a business invitee.
The complaint brings one count of negligence against Home Depot. It alleges the company owed Maldonado a duty to exercise reasonable care for her safety while she was lawfully on the property.
According to the complaint, Home Depot breached that duty in multiple ways. The filing alleges the company failed to maintain the premises, failed to inspect the premises or shelf for hazards, failed to warn Maldonado of a dangerous condition, failed to correct or replace that condition, failed to have adequate staff assigned to inspection and maintenance, failed to properly train employees, failed to follow its own corporate policies, failed to act reasonably under the circumstances, and failed to render aid or negligently rendered aid after the incident.
The complaint alleges that while Maldonado was shopping, she was struck by a boxed vacuum cleaner that had been moved from a shelf above her and placed on a ladder by a Home Depot employee. The filing says the box then abruptly fell and hit Maldonado in the neck, back, and shoulder.
Maldonado claims she suffered bodily injury and resulting damages, including pain and suffering, disability, disfigurement, scarring, mental anguish, loss of capacity for the enjoyment of life, medical and nursing expenses, lost earnings, loss of earning ability, and aggravation of a previously existing condition. The complaint alleges those losses are either permanent or continuing and says she will suffer losses in the future.
The lawsuit seeks a judgment against Home Depot for compensatory damages in excess of the court’s minimum jurisdictional limits, along with incidental and consequential damages, post-judgment interest, costs, and other relief the court deems proper. Maldonado also demanded a jury trial.
