Parents Sue American Heritage Schools, Alleging Retaliation, Contract Breaches, and Withheld Records

DELRAY BEACH, FL (Boca Post) (Copyright © 2025) — A Palm Beach County couple has filed a civil complaint against American Learning Systems of Boca Delray, Inc., which operates American Heritage Schools, alleging improper discipline, retaliation, contract breaches, and withholding of academic records involving both of their children. The case, Todd Bubello and Kimberlee Gibbs-Bubello, on behalf of their minor son, OGB, v. American Learning Systems of Boca Delray, Inc., was filed November 18, 2025, in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County under Case No. 502025CA012034XXXAMB.

The complaint was submitted by the Montgomery Law Group PLLC of North Palm Beach.

According to the filing, the plaintiffs allege that their son, identified as O.G-B., was involved in a May 29, 2025 bathroom altercation with another student. They claim the other student initiated the encounter, threatened him, and provided a false report to school administrators. The complaint states that no independent investigation occurred, witness accounts were biased, and their son was questioned alone by a dean without notice, documentation, or an opportunity to appeal.

The family alleges the school informed them by telephone on June 6, 2025, that their son was being withdrawn despite having completed his final exams. They claim the withdrawal resulted in the loss of transcript credit and disruption to his education at a new school. The filing states that his online accounts were cut off immediately, including access to a paid summer algebra course scheduled to begin three days later.

A second portion of the lawsuit concerns allegations made by his mother, Kimberlee Gibbs-Bubello, relating to her part-time employment at the school. The complaint states she had cooperated with the Florida Department of Law Enforcement in 2024 regarding a student group chat involving violent or threatening content. According to the lawsuit, the school later terminated her employment on September 30, 2024, citing minor policy issues. She alleges the termination occurred shortly after administrators became aware of her cooperation with law enforcement. The family claims this resulted in the loss of approximately $44,000 in tuition benefits tied to her employment.

The complaint also asserts that the school breached contracts for tuition, summer coursework, and ongoing enrollment. The plaintiffs allege the school refused to release both children’s academic records and transcripts, citing disputed tuition balances. According to the filing, tuition payments intended for their younger child, OGB2, were “cross-credited” to their withdrawn son’s account, leaving a balance of $12,663.98 and resulting in the withholding of OGB2’s report cards.

The lawsuit includes claims for breach of contract, breach of the covenant of good faith and fair dealing, retaliation, tortious interference, promissory estoppel, and injunctive relief. The family seeks damages, restitution of tuition payments, reinstatement of records, declaratory judgments regarding tuition obligations, and a court order requiring the immediate release of both children’s academic records.
