New Claims Made In Lawsuit.

DELRAY BEACH, FL (Boca Post) (Copyright © 2022) — A civil lawsuit has been filed recently following the tragic accident that left 6 dead after 16-year-old Noah Galle of Wellington crashed his 2019 BMW M3 into the back of a vehicle causing a crash in January.

The deadly accident, as previously reported by Boca Post, left 6 Pero Family Farmworkers dead after the vehicle they were in was hit from behind by Noah Galle who was operating his 2019 BMW M5 at a high rate of speed.

The family of one of the victims, Mirlaine I. Julceus, 45, has filed a lawsuit against Noah Galle as well as his parents Craig and Helana Galle.

The complaint was filed by Julceus’ family’s lawyer, Gregory Barnhart, of Searcy Denney Scarola Barnhart & Shipley, P.A.

‘Noah Galle operated his BMW northbound behind the vehicle driven by Mirlaine Julceus approaching at a high rate of speed, crashing into the rear of the vehicle driven by Mirlaine Julceus’

The complaint is broken down into 3 separate counts. The first count accused Noah Galle of negligence in the following actions:

  • Failing to observe traffic conditions
  • Excessive speed
  • Failing to yield the right of way to upcoming
  • Failing to take evasive actions to avoid a collision
  • Operating a motor vehicle while using a cellular phone
  • Failing to maintain control of his motor vehicle such that a collision occurred

For the 2nd and 3rd counts, Craig and Helena Galle are charged with negligence, respectively for:

  • Duty to make sure that their son operated his motor vehicle in a safe and careful manner
  • Authorized their son to apply for and obtain a driver’s license – making them liable for negligent acts until he is 18.

According to the filed complaint, Mirlaine I. Julceus’ husband and daughter are seeking damages including mental pain and suffering, loss of companionship and support, loss of support and services both past and present, medical expenses, and funeral expenses.

Court documents indicate that the claim is over $100,000; however, the exact amount of damages is not yet known.

As of today, Noah Galle has not yet been charged with any crime or cited with any traffic violations around this incident. Originally, PBSO reported that Galle may have been impaired at the time of the accident.

This new court filing indicates that Galle may have been using his cell phone during the accident. According to National Highway Traffic Safety Administration (NHTSA), Texting and driving is 6 times more dangerous than intoxicated driving.

It is unclear at this time if the families of the other 5 victims are planning in filing similar lawsuits against the Galle family.
