The complaint concerns a commercial lease dispute involving office space at 1625 S. Congress Avenue in Delray Beach.

DELRAY BEACH, FL — A Delray Beach office tenant is facing an eviction and damages lawsuit in Palm Beach County Circuit Court after a landlord alleged unpaid rent under a commercial lease for office space on South Congress Avenue.

The complaint, filed June 16, 2026, is captioned G&C Arbors Investors, LLC v. Aware Recovery Care of Florida LLC, Case No. 502026CA006739XXXAMB, in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida. The case is listed in Division AI.

G&C Arbors Investors, LLC, the plaintiff, filed a complaint for eviction and damages against Aware Recovery Care of Florida LLC, the defendant. The plaintiff is represented in the filing by Frank, Weinberg & Black, P.L., through attorney David W. Black.

The claims in the complaint are allegations and have not been proven in court.

According to the complaint, the dispute involves Suite 406 at 1625 S. Congress Avenue in Delray Beach. The lawsuit alleges Aware Recovery Care of Florida LLC is the tenant of the property under a written lease executed on or about Nov. 18, 2018, later amended by a First Amendment to Standard Office Lease executed on or about May 4, 2022.

The complaint states that, under the lease documents, the tenant was required to make monthly rent payments on the first day of each month. The lawsuit alleges the tenant defaulted on its obligations under the lease and that the landlord served a notice demanding payment or possession of the premises.

An exhibit attached to the complaint includes a June 3, 2026 notice of default directed to Aware Recovery Care of Florida LLC at 1625 S. Congress Avenue, Suite 406, Delray Beach. The notice states that the tenant was allegedly indebted to the landlord in the amount of $17,440.40 and demanded payment or delivery of possession within three days from delivery of the letter.

The lawsuit alleges that, through June 2026, $17,440.40 remained due, owing and unpaid. The complaint also claims rent would continue to accrue beginning July 2026 at a rate of $10,426.89 per month under the lease agreement.

The complaint includes two counts. Count I seeks possession of the real property and asks the court to issue a judgment for immediate possession of the Delray Beach office suite. It also asks for removal of the tenant and any others in possession of the premises, along with court costs, reasonable attorney’s fees and other relief the court considers appropriate.

Count II seeks damages for alleged breach of the lease agreement. The complaint alleges the tenant failed to pay rental amounts as they became due. It also states that the landlord claims it is entitled to accelerate rent for the balance of the lease term ending Sept. 30, 2027, plus interest and late fees. The filing says the accelerated rent damages exceed $50,000.
