BOCA RATON, FL (Boca Post) (Copyright © 2026) — A late-night disturbance in the city’s downtown district ended with a man in custody after what police describe as a confrontation with an officer outside a nightclub on Southeast First Avenue.

The incident unfolded just after midnight on March 22, 2026, in the area of 99 SE 1st Ave., a stretch of Boca Raton’s downtown corridor known for bars and nightlife activity. Boca Raton Police Department officers were dispatched to the location around 12:01 a.m. in response to a reported disturbance.

According to the arrest affidavit, officers arrived at Cosmos Nightclub and spoke with a security employee who reported that staff had removed a man from the business after he allegedly caused a disturbance inside. The man, later identified as 58-year-old Sergio Commisso of Deerfield Beach, remained outside on the sidewalk and was reportedly banging on the glass windows after being escorted out.

The security employee further told officers that Commisso had been “assaulting” patrons inside the venue prior to being removed, prompting staff to intervene and escort him out of the establishment.

When an officer made contact with Commisso outside the nightclub, the officer noted a strong odor of alcohol and described his speech as slow and slurred. Police reported that Commisso appeared unsteady on his feet while standing and initially became uncooperative when officers attempted to assist him in arranging a ride home.

The situation escalated when Commisso reportedly walked into the roadway near a parked vehicle along Southeast First Avenue, an area officers noted was still active with vehicle traffic at that hour. Police attempted to direct him back onto the sidewalk.

According to the affidavit, Commisso then turned toward the officer in what was described as an aggressive manner. The officer stated that Commisso closed the distance, got into the officer’s face, and raised his voice, saying, “I don’t know who the f*** you are.”

Based on the officer’s account, Commisso’s actions and proximity led the officer to believe he was about to become physically combative and had the apparent ability to carry out a battery. The officer responded by pushing Commisso away to create distance. Additional Boca Raton officers assisted, and Commisso was placed into handcuffs without further incident.

Commisso was charged with one count of assault on a law enforcement officer, firefighter, or medical personnel under Florida Statute 784.07(2)(a), a misdemeanor offense in this case.

Booking records show he was taken into custody shortly after midnight, with a booking time of 12:17 a.m. and later released on March 23.

The listed arresting agency is the Boca Raton Police Department. The incident occurred within city jurisdiction, and the case will be handled through Palm Beach County’s court system.

Commisso is scheduled to appear in court on April 23, 2026, at the South County courthouse in Delray Beach, located at 200 West Atlantic Avenue.

Under Florida law, assault on a law enforcement officer involves an intentional threat or act that creates a well-founded fear of imminent violence against an officer engaged in lawful duties. The charge does not require physical contact.

No injuries were reported in connection with the incident.
