BOCA RATON, FL (Boca Post) (Copyright © 2026) — A wrongful death lawsuit has been filed in Palm Beach County Circuit Court against a Boca Raton nursing home and its management company, alleging a resident suffered preventable injuries while in their care.

The case, Jayla Cabrera as Personal Representative of the Estate of Margarita Castillo v. Heartland Boca Opco, LLC d/b/a Boca Circle Rehabilitation Center; Excelsior Care Group LLC, was filed April 13, 2026, in the 15th Judicial Circuit in and for Palm Beach County under Case No. 502026CA004169XXXAMB.

According to the complaint, Cabrera is acting, or is in the process of being appointed, as personal representative of the estate of Margarita Castillo. The lawsuit names the operator of Boca Circle Rehabilitation Center and its management company, Excelsior Care Group LLC, as defendants. The filing was submitted by Dylan J. Hanson of Senior Justice Law Firm in Boca Raton.

The complaint alleges Castillo was a resident at the Palm Beach County facility and that both companies were responsible for her care under Florida’s nursing home laws.

According to the filing, Castillo was admitted for care related to ongoing medical conditions and cognitive changes. The complaint states she depended on staff for daily care and supervision and was at risk for preventable injuries, including skin breakdown, falls, infection, malnutrition, and dehydration.

The estate claims the defendants failed to provide the level of care required. It alleges those failures led to injuries, including wounds, infections, and severe skin breakdown in the form of pressure ulcers.

Those injuries, the complaint alleges, continued until Castillo’s death on February 22, 2025.

The lawsuit accuses both the facility operator and the management company of failing in multiple areas of care. Among the claims: failing to properly assess and treat skin conditions, failing to prevent falls and other injuries, failing to supervise at-risk residents, and failing to provide adequate hygiene, nutrition, hydration, and medical attention.

The complaint also alleges failures in staffing, training, and oversight, along with not following physician orders or notifying family members about changes in the resident’s condition.

The estate is seeking damages under Florida’s wrongful death statute, including medical and funeral expenses and other losses. The complaint also includes a survival claim, seeking damages for injuries Castillo allegedly suffered before her death.

The plaintiff is requesting a jury trial.
