BOCA RATON, FL — They told police they were trying to get out of the rain.
A Boca Raton trespass case began June 20 after officers found two people inside a NE 1st Avenue property where they were not authorized to be, according to probable cause affidavits filed in Palm Beach County court.
Boca Raton Police arrested Kevin Keane Petrick, 31, listed in jail records as at large in Boca Raton, and Ashley Dawn Sumrall, 37, listed as at large in West Palm Beach. Both were charged with trespassing in a structure or conveyance under Florida Statute 810.08(1), court and jail records show.
The incident happened at 120 NE 1st Avenue in Boca Raton, according to the affidavits. The court records list the cases as Palm Beach County misdemeanor cases.
The arrests come less than two weeks after Boca Post reported a separate Boca Raton case in which police accused two people of staying inside a vacant East Boca Raton Road home without permission. That earlier case involved burglary charges, while the NE 1st Avenue arrests are misdemeanor trespass cases, according to the records reviewed by Boca Post.
According to the affidavits, an officer responded to the property at about 9:01 p.m. after a report of trespassing. Before that officer arrived, a Boca Raton Police sergeant had already made contact with two people inside the property who were not authorized to be there.
Police identified them as Sumrall and Petrick.
Both told officers they were trying to avoid the rain and saw an open door leading to the second floor, according to the affidavits. Police wrote that the two said they went into an apartment hallway, saw another open door to the first room on the west side of the building, then entered the apartment and stayed inside.
The affidavit states Sumrall told police she knew the property was not hers and indicated she was not supposed to be there. Police also cited a posted no-trespass sign in the affidavit.
Both were taken to the Boca Raton Police Department booking facility and later to the Palm Beach County jail, according to the affidavits.
Jail records show Sumrall was booked at 11:44 p.m. June 20 and Petrick was booked at 11:59 p.m. June 20. Each had an original bond listed at $250 and a current bond of $0, with both released to supervised own recognizance on June 21.
Palm Beach County court dockets show probable cause was found in both cases during first-appearance proceedings. Court records also show no-contact orders were filed and counsel was appointed.
Sumrall’s case is listed under case number 50-2026-MM-005148-AXXX-SB. Petrick’s case is listed under case number 50-2026-MM-005156-AXXX-SB.
The charges are allegations. Neither defendant has been convicted in the cases based on the records provided.
