BOCA RATON, FL (Boca Post) (Copyright © 2026) — A Boca Raton property owner has filed a civil complaint seeking to evict a tenant and recover more than $935,000 in damages tied to a commercial lease dispute, according to a lawsuit filed March 3, 2026, in Palm Beach County.

The case, Lifetime Property VI, LLC v. Costas Maltezos, individually d/b/a Boca’s Best Pizzas, LLC and Boca’s Best Pizza, and George Larivee, individually, Case No. 502026CA002513XXXAMB, was filed in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida. The plaintiff is represented by Shapiro, Blasi, Wasserman & Hermann, P.A., based in Boca Raton, according to the complaint.

The filing identifies Lifetime Property VI, LLC as the owner of a commercial property located at 51 NW 1st Avenue in Boca Raton. The defendants include Costas Maltezos, alleged to be operating under Boca’s Best Pizzas, LLC and Boca’s Best Pizza, along with George Larivee. The allegations are claims made by the plaintiff and have not been proven in court.

According to the complaint, the parties entered into a written lease agreement on or about Aug. 7, 2025, for use of the property as a pizza restaurant. The lease term was scheduled to begin March 5, 2026, and run through March 4, 2036, a period of approximately 10 years.

The plaintiff alleges the lease required monthly base rent starting at $6,803 during the first year, with scheduled increases in subsequent years, along with additional obligations for operating expenses and taxes. The complaint further states that an $8,000 security deposit was due upon execution of the lease and was treated as rent under the agreement.

The central claim in the lawsuit is that the tenant failed to pay the required security deposit. According to the complaint, the landlord provided written notice of the alleged default and an opportunity to cure, but claims the tenant did not comply.

Based on that alleged default, the plaintiff seeks damages it calculates at $935,865.19, representing rent claimed to be due from March 2026 through the remainder of the lease term. The complaint also seeks late charges, interest, operating expenses, taxes, attorney’s fees, and court costs as permitted under the lease.

In a separate count, the plaintiff seeks eviction, alleging the tenant was served with a three-day notice to cure the default or vacate the premises, did not cure the breach, and did not surrender possession of the property.

A third count alleges breach of guaranty against both Maltezos and Larivee. The complaint states the defendants executed personal guaranties tied to the lease and are responsible for certain obligations following the alleged default, including rent and associated costs as outlined in the agreement.
