Guardian Estates Home Named In Cooper City Code Enforcement Lien Foreclosure Lawsuit

A single-family home at 5130 SW 101 Terrace in the Guardian Estates neighborhood of Cooper City is the subject property named in a code enforcement lien foreclosure complaint filed by the city in Broward County Circuit Court on July 7, 2026.

COOPER CITY, FL — The City of Cooper City has filed a civil complaint in Broward County Circuit Court seeking to foreclose on two municipal code enforcement liens attached to a home in the city's Guardian Estates neighborhood, according to court records.

The complaint, filed July 7, 2026, names United MYM, LLC, the record owner of 5130 SW 101 Terrace, along with two unknown tenants as defendants. The case, styled City of Cooper City v. United MYM, LLC, et al., was assigned Case No. CACE-26-011002 in the 17th Judicial Circuit for Broward County and is docketed in Division 11.

The lawsuit was filed by attorneys Jacob Horowitz and Aaron S. Brenker of Goren, Cherof, Doody & Ezrol, P.A., a Fort Lauderdale law firm listed in the complaint as counsel for Cooper City. Brenker signed the filing.

According to the complaint, the case seeks a final judgment of foreclosure under Chapter 162 of the Florida Statutes, the state law governing municipal code enforcement liens. The filing alleges that two separate code enforcement liens remain unpaid on the Guardian Estates property, together with per diem fines that continue to accrue.

Two counts, two liens

Count I of the complaint concerns Cooper City Code Enforcement Case No. 240607. The filing states that the city's Code Enforcement Special Magistrate issued a Finding of Violation Order on June 17, 2024, finding a violation of Section 25-102 of the Cooper City Code of Ordinances at the property. The complaint alleges that an Order Imposing Fine and Lien was entered on August 21, 2024, and that a certified copy of the order was recorded in the Broward County Public Records on October 18, 2024, as Instrument No. 119855807.

The filing says the amount due under the Count I lien is $119,704.00 through June 17, 2026, and that the fine continues to accrue at a per diem rate of $150. The complaint claims the amount remains wholly unpaid.

Count II concerns Cooper City Code Enforcement Case No. 230005. The complaint alleges that the Code Enforcement Special Magistrate issued a Finding of Violation Order on September 18, 2023, finding a violation of Florida Building Code Section 105 as adopted by Section 6-7 of the Cooper City Code of Ordinances. An Order Imposing Fine and Lien was entered on November 9, 2023, and recorded in Broward County on December 13, 2023, as Instrument No. 119281852, according to the filing.

The complaint states that $109,304.00 is due under the Count II lien and that the amount also remains unpaid.

Path to foreclosure

The lawsuit alleges that United MYM, LLC took title to the Guardian Estates property by warranty deed recorded on December 20, 2022. The complaint identifies the property by its full legal description, Lot 4, Block 4, Guardian Estates, as recorded in Plat Book 81, Page 41 of Broward County's public records, and by Property ID No. 504131020570.

According to the filing, Chapter 162 of the Florida Statutes allows a municipality to foreclose on a code enforcement lien with city commission approval once a lien has been unpaid for three months or more. The complaint states that the Cooper City Commission authorized foreclosure of the liens on April 28, 2026.

Relief sought

The filing asks the court to enter a final judgment of foreclosure allowing the subject property to be sold to satisfy the city's claims if the sums are not paid within a time set by the court. The complaint also seeks to bar any competing claims to the property from parties claiming through the defendants after the filing of a Notice of Lis Pendens and asks that any sale proceeds be applied to the city's lien. Cooper City is also seeking interest, costs, expenses, attorney's fees and other relief the court deems just and proper, according to the filing.
