MorseLife Memory Care Faces Palm Beach County Lawsuit Over Alleged Pressure Sore Injuries

A newly filed complaint in Palm Beach County Circuit Court alleges a MorseLife Memory Care resident developed severe pressure sores at the assisted living facility, according to court records.

MorseLife Memory Care Faces Palm Beach County Lawsuit Over Alleged Pressure Sore Injuries

WEST PALM BEACH, FL — A Palm Beach County family has filed a civil lawsuit against the operator of a West Palm Beach memory care residence, alleging a resident developed severe pressure sores to both heels while in the facility's care, according to a newly filed complaint.

The case, Anthony Kost as Power of Attorney for Rose Kost v. The Joseph L. Morse Health Center Inc. d/b/a MorseLife Memory Care Residence, was filed June 25, 2026 in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County, Florida. Court records list the case number as 502026CA007146XXXAMB, assigned to Division AD. Plaintiff's counsel is Scott M. Fischer of Morgan and Morgan in West Palm Beach.

The complaint says Rose Kost was admitted to the defendant's assisted living facility in Palm Beach County, and that Anthony Kost serves as her power of attorney. The lawsuit alleges the claim arises from the development of severe bilateral pressure sores to both heels at the facility.

According to the complaint, the injury was first documented at the facility on November 6, 2024, when records reportedly noted that "resident has a blister on her foot that dried up and is now seeping" and that a dressing was applied. The lawsuit alleges that by November 11, 2024, an advanced practice registered nurse described the right heel wound as unstageable with 100% devitalized tissue and a strong odor, and the left heel wound as Stage 2.

The complaint states Rose Kost was transferred to another facility on November 13, 2024, where the lawsuit alleges her wounds were ultimately classified as Stage 3 and Stage 4 and were found to be infected with osteomyelitis. The filing says wound cultures identified Proteus mirabilis and that she was placed on intravenous Ceftriaxone and Vancomycin.

The lawsuit also points to a November 22, 2024 arterial duplex study, alleging the test showed no significant flow-limiting lesions and that, according to the complaint, this supports the claim that the wounds were pressure related rather than caused by underlying vascular disease.

The complaint brings a single count under Chapter 429 of the Florida Statutes, which governs assisted living facilities in Florida. In plain terms, the lawsuit alleges the facility failed to honor a resident's statutory rights, including the right to live in a safe environment free from abuse and neglect and the right to adequate and appropriate health care. The complaint also alleges the defendant failed to properly hire, retain, and supervise staff.

The plaintiff seeks damages in excess of $50,000, plus costs and interest, and demands a trial by jury, according to the filing. The complaint lists alleged damages including bodily injury, pain and suffering, mental anguish, loss of dignity, and medical, hospital, and nursing expenses.

The filing reviewed by Boca Post does not include a response from the defendant. Allegations in a civil complaint are not findings of fact, and the claims have not been proven in court.
