BOCA RATON, FL — A Boca Raton man was arrested by the Palm Beach County Sheriff’s Office after investigators responded to a report involving alleged lewd conduct with children, according to Palm Beach County court and jail records.
Jose Nazario Diaz, 45, was booked into the Palm Beach County jail on May 31, 2026. Court and arrest records list two counts of lewd or lascivious molestation of a victim younger than 12 by an offender 18 or older under Florida Statute 800.04(5)(b). The records list the case as a felony matter.
The case is filed in Palm Beach County Circuit Court under case number 50-2026-CF-004068-AXXX-MB.
According to the probable cause affidavit, PBSO detectives responded late May 30, 2026, to a redacted location after a report of a lewd and lascivious act. Victim names, addresses and other identifying information were redacted from the records under Marsy’s Law and protections related to child abuse and sexual offense victims.
The affidavit states a deputy spoke with two children, ages 5 and 8, during the initial investigation. One child reported being touched in the genital area, while the other reported being touched over her clothing while watching television, according to the affidavit.
Detectives also interviewed adults at the residence, the affidavit states. One adult told investigators she saw Diaz’s hand on one child’s genital area while children were in the living room watching television. Another adult reported that a child was crying and said Diaz had touched her while they were on the couch, according to the affidavit.
PBSO detectives later interviewed Diaz in Spanish after advising him of his Miranda rights, according to the affidavit.
Investigators wrote that Diaz initially denied touching the children. The affidavit states Diaz later made admissions about touching both children while seated on a couch, said the conduct was inappropriate, and voluntarily provided a DNA sample.
The affidavit states Diaz was transported to the Palm Beach County jail for booking and processing.
Palm Beach County court records show probable cause was found, a public defender was appointed, and Diaz appeared in custody by video with a Spanish interpreter at first appearance. The docket also lists bond as none.
Court records show a 30-day return hearing scheduled for June 30, 2026, and an initial case conference scheduled for August 6, 2026.
The charges are allegations. Diaz has not been convicted in the case based on the records provided.
According to court records, he was born in El Salvador. Boca Post could not immediately confirm his current citizenship or immigration status in the United States.
