Boca Raton Lawsuit Alleges Unauthorized Use Of Broker’s Name On One Boca Flyer

A Boca Raton real estate broker claims in a Palm Beach County lawsuit that his name was used without consent on a political flyer promoting a One Boca Project meeting.

The complaint filed in Palm Beach County Circuit Court alleges unauthorized use of a Boca Raton broker’s name on a flyer promoting a One Boca Project meeting.

BOCA RATON, FL — A Boca Raton real estate broker has filed a civil lawsuit in Palm Beach County Circuit Court alleging his name was used without permission on a flyer promoting a meeting tied to the One Boca Project, according to a newly filed complaint.

The case, David Roberts v. Frisbie Group, LLC, Bonnie Miskel, Miskel Backman, LLP, and A Better Boca Raton, Case No. 502026CA005833XXXAMB, was filed May 22, 2026, in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida. The complaint lists Roberts as the plaintiff and identifies his attorneys as Graner Platzek & Allison, P.A., of Boca Raton.

The lawsuit alleges that Roberts, described in the filing as a Royal Palm Yacht & Country Club resident and a local real estate broker, was falsely identified as a host of a March 3, 2026, meeting about the Boca Raton Government Campus Redevelopment Project, also referred to in the complaint as the One Boca Project.

The claims are allegations made by the plaintiff and have not been proven in court.

According to the complaint, the disputed flyer invited recipients to “join us for an evening” to learn about the proposed government campus revitalization. The filing says the flyer listed the meeting at Royal Palm Yacht & Country Club, 2425 W. Maya Palm Drive in Boca Raton, from 5:30 p.m. to 7:30 p.m., and identified the event as “Hosted by: David Roberts” and Joel Altman.

The complaint states that the flyer was marked as a paid political advertisement paid for by A Better Boca Raton. Roberts alleges he never agreed to host, attend, sponsor, support, endorse, approve, or otherwise affiliate himself with the meeting or the One Boca Project.

The lawsuit claims that before the flyer was published, Miskel contacted Roberts to request permission to use his name in connection with the meeting. According to the complaint, Roberts rejected that request and said he did not consent to the use of his name.

Despite that alleged refusal, the complaint claims the defendants published and disseminated the flyer identifying Roberts as a host. The lawsuit alleges that the use of his name suggested to recipients that Roberts was connected to, supporting, or endorsing the meeting and the One Boca Project.

The complaint describes the One Boca Project as a proposed redevelopment and revitalization project concerning the government campus for the City of Boca Raton. It alleges Frisbie Group had a significant economic interest in promoting and obtaining support for the project, which the complaint says involved a bid to develop city-owned land with mixed-use components including office space, a grocery store, a hotel, residential units and parking spaces.

Roberts claims the flyer created confusion within the Royal Palm community and the broader Boca Raton real estate community. The complaint alleges that after the flyer was distributed, multiple members and residents of Royal Palm contacted Roberts to express disappointment that he appeared to be endorsing or supporting the One Boca Project.

The lawsuit brings claims including unauthorized publication of name or likeness, common law misappropriation of name, defamation per se, defamation by implication, false association and false endorsement under federal law, civil conspiracy, and aiding and abetting claims pleaded in the alternative.

Roberts seeks damages, costs, pre-judgment interest, injunctive relief related to further use of his name, attorney’s fees where applicable, and any other relief the court deems appropriate. The complaint also demands a jury trial.

The filing reviewed does not include a response from the defendants.
