LAWSUIT: Cosmo’s Used Models’ Photos Without Consent

A Palm Beach County civil complaint alleges Cosmo’s Nightclub & Lounge in Boca Raton used models’ images in promotional materials without authorization.

BOCA RATON, FL — A Boca Raton nightclub operator is facing a civil lawsuit in Palm Beach County Circuit Court after seven professional models alleged their images were used in social media promotions without their permission, according to a newly filed complaint.

The complaint, filed May 26, 2026, in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, names Marketa Lim, also known as Marketa Kazdova, Jessica Billings, Katarina Van Derham, Janet Guzman, Stephanie Rao, Tiffany Toth, also known as Tiffany Gray, and Sandra Valencia as plaintiffs. The case is Marketa Lim a/k/a Marketa Kazdova, et al. v. JCD Boca Corporation d/b/a Cosmo’s Nightclub & Lounge, Case No. 502026CA005889XXXAMB, Division AE.

The defendant is JCD Boca Corporation, doing business as Cosmo’s Nightclub & Lounge. The complaint identifies Cosmo’s as a nightclub located at 99 SE 1st Avenue in Boca Raton. The plaintiffs are represented by The Casas Law Firm, P.C. of Miami, according to the filing.

The claims are allegations made by the plaintiffs and have not been proven in court. The filing reviewed by Boca Post does not include a response from the defendant.

According to the complaint, the plaintiffs allege Cosmo’s used their images, likenesses or identities over a period of several years to advertise, promote and market the nightclub through social media accounts associated with the business. The lawsuit claims the images were used in promotional materials for nightclub events without the models’ consent, without negotiated licensing terms and without payment.

The complaint alleges the use of the images created a misleading impression that the models were affiliated with Cosmo’s, had agreed to promote the business, had appeared or would appear at events there, or worked as dancers or entertainers for the nightclub. The plaintiffs claim they would not have agreed to the use of their images if asked.

The filing includes exhibits showing promotional graphics and social media screenshots for several Cosmo’s events, including posts labeled “Back 2 School Party,” “Something About Saturday Night,” “Naughty or Nice?” and “Sunday Latin Party.” The complaint alleges those materials appeared on Facebook or Instagram accounts tied to the nightclub.

The lawsuit brings claims for violation of Florida Statute 540.08, common law invasion of privacy by misappropriation, common law conversion and unjust enrichment. In plain terms, the plaintiffs allege the nightclub used their images for commercial promotion without authorization and benefited from that use.

The complaint states that each plaintiff works in modeling, acting, hosting, social media or related professional work where image, reputation and brand control are part of their livelihood. The lawsuit claims unauthorized commercial use of those images can affect the ability to negotiate paid work, control endorsements and protect professional reputation.

The plaintiffs are seeking damages in excess of $50,000, exclusive of interest, attorneys’ fees and costs. The complaint also seeks damages under Florida law, general damages, special damages, consequential damages, royalties, restitution of alleged unlawful proceeds and other relief the court may deem proper. The plaintiffs also request a jury trial.

The case remains a newly filed civil complaint pending in Palm Beach County court. The filing reviewed does not include a defense response or any ruling on the plaintiffs’ allegations.
