BOCA RATON, FL (Boca Post) (Copyright © 2026) — A civil complaint filed May 1, 2026, in the Circuit Court for the 15th Judicial Circuit in and for Palm Beach County names Heartland Boca OPCO LLC, doing business as Boca Circle Rehabilitation Center, as defendant in a case brought by Brandon Rubin, acting as next friend of Barbara Rubin.
The case, styled Brandon Rubin, as Next Friend of Barbara Rubin v. Heartland Boca OPCO LLC d/b/a Boca Circle Rehabilitation Center, Case No. 502026CA004924XXXAMB, was filed in the court’s civil division.
According to the complaint, Brandon Rubin is represented by the law firm of Ford, Dean & Rotundo, P.A., while the filing does not list defense counsel. The plaintiff alleges damages in excess of $50,000, exclusive of interest and costs, and requests a jury trial.
The complaint states that Barbara Rubin, a Palm Beach County resident, was a patient at Boca Circle Rehabilitation Center and was suffering from infirmities that impaired her ability to provide for her own care and protection. The plaintiff claims those alleged failures led to falls and unexplained injuries. The complaint further states that Heartland Boca OPCO LLC owned and operated the facility and was subject to Florida statutes governing nursing home operations, including requirements related to resident care and supervision.
Filed as a Chapter 400 claim under Florida law, the lawsuit alleges violations of resident rights. The complaint outlines duties the facility was required to meet, including providing adequate healthcare and protective services, preventing abuse, complying with regulatory standards, and treating residents with dignity.
The plaintiff alleges the defendant failed to meet those obligations in several ways. Among the claims are that staff did not implement proper fall precautions, failed to adequately supervise and monitor the resident, and did not maintain appropriate care plans. The plaintiff seeks compensatory damages for the alleged deprivation of statutory rights, as well as other relief permitted under Florida law. The complaint also notes the plaintiff reserves the right to pursue punitive damages at a later stage.
