PALM BEACH COUNTY, FL (Boca Post) (Copyright © 2025) — A Palm Beach County woman has filed a civil lawsuit alleging she was injured while riding as a passenger in an Uber vehicle during an April crash.

The complaint, filed December 4, 2025, in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, sets out three counts against Uber Technologies, Inc., its subsidiary Rasier, LLC, and the driver, Jaslain Elismond. The case is captioned Kelly Rothenburg v. Uber Technologies, Inc.; Rasier, LLC; and Jaslain Elismond, Case No. 502025CA012626XXXAMB .

According to the filing, plaintiff Kelly Rothenburg, a Palm Beach County resident, was riding in a 2022 Toyota Highlander operated by Elismond on April 19, 2025. The complaint states that Elismond, who the suit identifies as an “Uber Driver-Partner,” was driving in the course and scope of his relationship with Uber and Rasier at the time. The document alleges that Elismond “recklessly and negligently” operated the vehicle, causing a collision with a 2023 Dodge Ram 1500 driven by non-party Devin Robert. The crash occurred somewhere within Palm Beach County, though the filing does not specify the roadway.

Rothenburg claims she suffered permanent injuries as a result of the impact. Her allegations include physical injury, aggravation of pre-existing conditions, disfigurement, mental anguish, and loss of earning capacity, among other categories of damages outlined in the complaint.

The lawsuit’s first count asserts a negligence claim against Elismond. Rothenburg alleges that the driver failed to operate the Toyota in a careful and lawful manner, which resulted in the collision and her injuries. She seeks damages in excess of $50,000, exclusive of fees and costs, and demands a jury trial.

The second count alleges vicarious liability against Rasier, LLC, and Uber Technologies, Inc. The complaint claims that Elismond was acting as an employee or agent of the two companies while performing tasks assigned to him, and that the companies are therefore legally responsible for the actions he took during his work. The filing states that Uber and Rasier breached their duty to ensure safe operation of the vehicle through the conduct of their driver.

A third count alleges negligent hiring by Uber and Rasier. According to the complaint, the companies “failed to make an appropriate and reasonably thorough investigation” into Elismond before allowing him to operate a vehicle for rideshare tasks. The suit claims that a proper investigation would have shown he was unsuitable for the responsibilities required. As with the other counts, Rothenburg seeks damages for various physical, emotional, and financial harms.

The lawsuit was filed by attorney Gregory Huber of Zele Huber Trial Attorneys, P.A., located in Jupiter, Florida. The four-page filing includes a demand for a jury trial and outlines each party’s alleged role in the incident. All allegations described in the complaint remain unproven at this stage.
