DELRAY BEACH, FL (Boca Post) — A Delray Beach woman was arrested for DUI on Tuesday night after a witness reportedly observed her crash in to the elevator door on the 4th floor of the Old School Square Parking Garage in Delray Beach.

Dawn Everett, 48, of Citation Club Apartments in Delray Beach, was arrested by Delray Beach Police Department just after 11pm on Tuesday, January 18th, 2022. According to a police report submitted by Delray Beach Police Department, it is reported that a witness observed Everett crash a vehicle in to the elevator door on the 4th floor at the Old School Square Garage in downtown Delray Beach.

The witness reports that he approached the vehicle out of concern for the driver when he observed her “lighting something on fire” inside of the vehicle. The witness called police and waited for their arrival. When police arrived, they made contact with the Everett who allegedly refused to exit the vehicle. It is reported that Everett just kept revving the engine and shifting back and forth from reverse to neutral disobeying officers orders to exit the vehicle. Officers were able to gain access via the back door and turn off the vehicle. Everett was then taken into custody without further incident.

Officers report the smell of a “strong odor of an unknown alcoholic beverage” so a DUI investigation was initiated. Everett was unable to complete and field sobriety tests due to being handcuffed and shackled. Everett later refused to provide a breath sample after saying she would actually comply. Everett was later escorted to the PBSO jail where she was later released without any bail.

As a result of this incident, Everett is now facing the following charges:

  • DUI-UNLAW BLD ALCH – DUI DAMAGE TO PROPERTY OR PERSON OF ANOTHER (316.193 3C1 (MF))
  • RESIST OFFICER – OBSTRUCT WO VIOLENCE (843.02 (MF))

According to court documents, Everett has retained Matthew Shafran of Weinstein Legal to defend her with this case. Everett has entered in to a plea of not guilty and is demanding a jury trial.
