BOCA RATON, FL (Boca Post) — A Boca Raton woman is suing the owners of “The Boardwalk at 18th Street” after she broke and dislocated her knee when she slipped and fell at the mixed-use commercial property.

The Boardwalk at 18th Street is known as many things, including just “The Boardwalk”. The popular mixed-use commercial property that borders Boca Pointe at 18th street at 6909 SW 19th Street in Boca Raton is also the location of many doctors’ offices.

According to a newly filed lawsuit, on May 25th, 2018, Kelsey Morosini, was visiting one of those doctor’s offices, a pediatrician’s office for one of her children. At some time during the visit, Kelsey Morosini, slipped and fell on the floor of the interior entrance of the building because the floor was unreasonably slippery and was wet.

The lawsuit claims that there was no warning that the floor was wet. As a result of the slip and fall, Morosini sustained a serious injury to her left knee, which was ultimately diagnosed as being a lateral patellar dislocation and fracture of the condyle/patella. Morosini has undergone surgery(s), resulting in permanent limitations, permanent restrictions, and permanent scarring.

According to the lawsuit, Boca Wharfside, LLC, owner of the property, breached its duty of care owed to the public in the following manner:

  • Failing to insure a safe and hazard-free environment.
  • Failing to properly inspect the subject property.
  • Failing to properly warn that the subject floor was slippery when dry and/or wet.
  • Failing to properly design, construct, clean, and/or maintain the subject property.
  • Failing to protect its invitees from known hazards on the property.
  • Failed to put caution or warning signs in the area where the incident occurred when raining, specifically being the area of ingress and egress from the parking lot.
  • Failed to take proper and necessary safety precautions to prevent the incident which caused injury to Kelsey Morosini.
  • Failing to maintain its premises in a reasonably safe condition.
  • Failing to ensure that the subject property complied with all applicable Florida building, safety, accessibility, and maintenance codes.
  • Failing to ensure the placement of detectable visible markings or warnings of the dangerous condition.
  • By allowing the dangerous condition to exist.

Kelsey Morosini, suffered damages including pain and suffering, disability, disfigurement, scarring, mental anguish, loss of the capacity to the enjoyment of life, the expense of hospitalization, and medical and nursing care and treatment. These losses are permanent and continuing in nature and Kelsey Morosini will suffer these losses in the future.

Kelsey’s husband, Fred Morosini, is also a plaintiff in the lawsuit against the owners of The Boardwalk of 18th Street. The lawsuit alleges that as a result of the injuries sustained by Kelsey Morosini, her husband, Fred Morosini, was caused to suffer in the past and to some extent will continue to suffer in the future loss of consortium, loss of society, loss of affection, loss of assistance, and loss of services.
