BOCA RATON, FL (Boca Post) (Copyright © 2025) — Two professional models have filed a civil lawsuit in Palm Beach County, alleging that a Boca Raton nightclub used their images without permission to promote its events. The complaint, filed November 18, 2025, accuses One11 Boca LLC d/b/a One11 / One11 Boca of misappropriating the models’ likenesses and identities for commercial gain.

The case is titled Janet Guzman and Antje Utgaard v. One11 Boca LLC, Case No. 502025CA012038XXXXMB, and was filed in the Fifteenth Judicial Circuit Court in and for Palm Beach County, Florida. The plaintiffs are represented by The Casas Law Firm, P.C., Miami.

According to the complaint, the two plaintiffs — both professional models — allege that the nightclub used their images in digital advertisements and event promotions posted on its social media accounts. The lawsuit states these uses created the false impression that the plaintiffs worked for, endorsed, or were otherwise affiliated with One11, which the plaintiffs deny. The filing asserts that neither model granted permission or received payment for the use of their images.

Allegations Regarding Janet Guzman

The complaint states that plaintiff Janet Guzman has a significant social media presence and works as a model and public figure. According to the filing, her image and likeness were used in at least one advertisement and four promotional posts for themed events at the nightclub. Attached exhibits show flyers advertising “Latin Night Fridays,” which featured Guzman’s likeness.

Guzman alleges the promotions created the appearance that she “has consented or agreed to promote, advertise, market or endorse One11,” or that she worked as a dancer or entertainer at the club. The complaint states she has never been employed by One11, never contracted with the business, and never granted rights for her image to be used.

Allegations Regarding Antje Utgaard

Co-plaintiff Antje Utgaard, also described as a well-known model and actress, alleges her likeness was similarly used in at least one advertisement and one promotion for One11 events. The lawsuit states this included a holiday-themed “Santa-Con” event advertisement in which her image was altered with added holiday graphics and a promotional tagline.

Utgaard alleges the unauthorized advertising implied she was a dancer, entertainer, or host affiliated with One11, which she denies. The complaint states she has never worked for or contracted with the nightclub.

Legal Claims

The lawsuit brings four counts:

  • Violation of Fla. Stat. § 540.08 — unauthorized publication of name, image, likeness, or identity;
  • Common law invasion of privacy / misappropriation;
  • Conversion;
  • Unjust enrichment.

The plaintiffs allege the club benefited commercially from the use of their images and that the conduct deprived them of the right to control how and where their identities are used—an important aspect of the modeling industry, the complaint notes. They seek compensatory damages, statutory damages, disgorgement of profits, attorneys’ fees where applicable, and a jury trial.

The filing also states that the underlying promotional posts and flyers were published on One11’s social media pages, including Facebook and Instagram, which were used to advertise the nightclub’s events and entertainment offerings.

The lawsuit emphasizes these are allegations, and no findings have been made.
