BOCA RATON, FL (Boca Post) (Copyright © 2026) — A civil complaint filed March 20 in Palm Beach County alleges a minor was injured during a go-kart collision at Boomers Boca Raton and seeks damages from the company that operates the facility.
The case, Stephanie Barisoni, as Natural Parent and Guardian of a minor, and Stephanie Barisoni, individually, v. APX Boomers! Boca Raton, LLC, Case No. 502026CA003208XXXAMB, was filed in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida. The complaint names John Kilpatrick Law, PLLC as counsel for the plaintiffs. No defense attorney was listed in the complaint.
According to the complaint, Stephanie Barisoni filed suit both individually and as parent and natural guardian of her daughter, who is identified in the court filing but is being withheld here because she is a minor. The defendant, APX Boomers! Boca Raton, LLC, is identified in the complaint as the owner and operator of Boomers Boca Raton.
The lawsuit states the claims have not been proven in court.
According to the complaint, Barisoni and her daughter visited Boomers Boca Raton on March 20, 2024, and the child rode on the facility’s go-kart track. The complaint alleges the track was open to multiple patrons at the same time and that other individuals on the track were driving recklessly.
The suit claims the defendant failed to adequately supervise drivers on the track, failed to enforce safety rules, failed to warn the minor or her mother about the dangers associated with reckless driving by other patrons, and failed to adequately train employees responsible for supervising the attraction.
The complaint alleges that while the minor was operating her go-kart, another driver rear-ended her kart. It claims the impact caused her head to snap backward and strike the headrest area of the kart, causing injuries that required medical treatment.
Barisoni also claims in the suit that she incurred medical expenses for her daughter’s treatment and suffered loss of services, companionship, and consortium as a result of the alleged injuries.
The complaint asserts six counts against APX Boomers! Boca Raton, LLC: negligence, negligent supervision, negligent failure to warn, negligent training of employees, premises liability, and a derivative claim brought by the mother.
In its negligence count, the lawsuit claims the facility owed a duty to operate safely, supervise activities on the premises, and protect patrons from foreseeable harm. It alleges that duty was breached through inadequate supervision, failure to enforce safety rules, failure to prevent reckless driving, and failure to maintain safe operations on the go-kart track.
In the negligent supervision and negligent training counts, the complaint claims the company failed to have adequate staff present and failed to properly train employees to supervise drivers, identify reckless driving, stop unsafe conduct, and enforce track rules.
In the failure to warn and premises liability counts, the suit alleges the defendant knew or should have known that reckless driving by patrons posed a risk of collision and injury, and claims the company failed to post adequate warnings or provide verbal warnings about those risks.
The plaintiffs seek compensatory damages for medical expenses, pain and suffering, emotional distress, loss of services, companionship and consortium, interest, court costs, and other relief the court deems proper. The complaint also demands a jury trial.
