BOCA RATON, FL (Boca Post) — A Boca Raton man is facing battery, burglary, and criminal mischief charges, according to jail records released to Boca Post by the Palm Beach County Sheriff’s Office.

A man from the Boca City Walk Apartments in Boca Raton, was arrested Thursday morning by the Boca Raton Police Department. Boca Post has been notified that the charges filed include burglary, battery, and criminal mischief.

According to an arrest affidavit submitted by the Boca Raton Police Department, an officer arrived at the Trader Joe’s at 855 South Federal Highway in Boca Raton to meet with a victim who wanted to report that she had just been attacked.

The woman alleges that her ex-husband, kicked her vehicle and punched her in the face while she was trying to drop their child off for ‘his weekend’.

Boca Post is publishing a redacted version of the official arrest affidavit below:

“Upon arrival, I met with a woman who advised that she was in an altercation with her ex-husband regarding their children at near the 30 block of SE 8th Street. The woman explained that she came to the residence to drop off her daughter since there was no school today and it was the ex husband’s weekend to have the children. Prior to dropping the child off, the child contacted her father who was upset and was verbally abusive to her yelling and screaming while talking about her mother. As the woman arrived at the front of the condominium complex, the ex husband came to the outside and confronted her at her vehicle. According to the woman, the ex husband started to yell and scream profanities at her, began to kick her vehicle on the driver’s side door, and then opened her vehicle door which was unlocked, and punched her with a closed fist on the left side of her face while she was sitting inside. The woman explained that she was in fear and then drove off to the parking lot of 855 South Federal Highway (Trader Joe’s). The woman had pain to both sides of her face around her jaw area. Boca Raton Fire Rescue responded to the scene and treated the woman for her injuries. Upon visual examination of the vehicle, there was a dent to the driver’s side door just below the door handle. According to the woman, the approximate cost to fix the damage could be over $1000.”

“I met with the child who was in the vehicle during the incident. The child advised that prior to arriving at her father’s residence, she contacted him via phone. The child explained that he began yelling and screaming at her saying bad things about her mother. According to The child, when they arrived at the front of the residence, her father came to the vehicle and was very upset. He then began yelling and screaming, started kicking her mother’s vehicle, and then opened the door to the vehicle and punched her mother in the face with his right fist. Her mother was scared and then drove off into the parking lot of Trader Joe’s.”

“I attempted to contact the ex-husband at his residence and was met with negative results. I then attempted to call him several times, but he did not answer. Based on my investigation, probable cause exists for the arrest of the ex-husband on the charges of Simple Battery (Domestic), Felony Criminal Mischief, and Burglary.”

“I contacted The Department of Children and Families and spoke with Chelsey (ID573) who advised a report would be generated. The woman was given a Domestic Violence pamphlet. Photos of the damage to her vehicle were taken along with photos of her. A Victims’ Right to Confidentiality was signed. Body Worn Video was submitted into Evidence.”

A warrant was issued for the arrest of the ex husband who was booked into the Palm Beach County Jail at 4:44 on Thursday morning where he remains at the time of this writing. Court records indicate the ex husband saw a judge this morning who ordered he has no contact with the ex-wife or their child.
