BOCA RATON, FL (Boca Post) (Copyright © 2021 The Boca Post) — A Boca Man was arrested for DUI in the early hours of 11/24 when he was pulled over for several traffic violations only after one of the officers seen him in a bar about 6 hours earlier.

Neil Weiner, 34, of Boca Raton, was observed driving his Toyota MR2 on the wrong side of the road with no headlights on. That is when he was pulled over by Boca Raton Police Department at about 1AM on 11/24.

A backup officer arrived and recalled seeing Weiner at ‘Artful Dodger’, a local bar, earlier that evening. The officer wrote in his report that he observed Weiner request ‘anything’ from the bartender before he allegedly drank what the officer described as a ‘Shock Top’ beer. The officer reports that at that time Weiner spoke normal and did not have any obvious issues with his balance.

Then, the same officer showed up to assist at the traffic stop on Federal Highway where Weiner was now outside of his vehicle it is reported that he immediately recognized him due to his hair cut, facial hair, and clothing. The officer also noted that he saw the same small dog in the car that Weiner had with him in the bar earlier.

After speaking with Weiner the officer determined that the he was intoxicated. Weiner asked several times if he could just walk home and when the officer asked why he would walk Weiner had no real good answer. The officer suspected Weiner drove while intoxicated so he requested that Weiner perform some field sobriety tests to which Weiner declined. Weiner refused all field sobriety tests, refused to sign his traffic citations, and later refused to provide a breath sample.

Weiner was escorted to BRPD and then to PBSO jail where he was released to his own recognizance without bond later that morning. He has the following charges / infractions:

  • 316.193(1) TCATS – DRIVING UNDER THE INFLUENCE
  • 318.14(3) TCATS PERSON WILLFULLY REFUSES TO ACCEPT AND SIGN CITATION
  • 316.217(1A) TCATS VEHICLE WITHOUT LIGHTS AT NIGHT
  • 316.151(1A) TCATS IMPROPER RIGHT TURN
  • 316.081(1) TCATS DRIVING ON WRONG LANE OR SIDE – FAILED TO DRIVE UPON RIGHT HALF OF ROADWAY

According to court records Weiner has hired Douglas Leifert, of Leifert & Leifert, a law firm located in Delray Beach, to represent him.
