BOCA RATON, FL — The stolen scooter went up for sale on Facebook Marketplace before the owner even knew it was gone.
That's the scene laid out in a Palm Beach County Sheriff's Office probable cause affidavit that led to the arrest of a West Boca man more than a year after the alleged theft.
Robert David Erclauz, 47, was booked into the Palm Beach County Main Detention Center on Saturday, June 28, 2026, on one felony count of dealing in stolen property by use of the internet, according to jail records. His bond was set at $5,000, and a first appearance was scheduled for the following morning. Erclauz lives on Hacienda Court in West Boca, jail records show.
The arrest warrant was signed on December 16, 2025, and a direct-file warrant and probable cause affidavit were filed in Palm Beach County Circuit Court three days later, court records show. The case is filed under case number 50-2025-CF-010112-AXXX-MB.
According to the affidavit, the case started on the evening of June 23, 2025, when a man parked his black HiBoy S2 electric scooter at a bike rack outside an EOS Fitness location in unincorporated Palm Beach County. He locked the scooter using its companion phone app and went inside to work out, the affidavit states.
When he came back out a little before 7:10 p.m., the scooter was gone.
The owner and a witness who was with him went home and began scrolling Facebook Marketplace for "black scooters for sale" in the area, the affidavit states. Less than three hours after the scooter was reported missing, they spotted a listing that matched their scooter in Boca Raton. The asking price was $50. The scooter is valued at roughly $399.99, according to the affidavit.
The seller, identified in the affidavit as Erclauz, allegedly responded to a Facebook Messenger inquiry from the owner posing as a buyer and sent his home address as the meeting location for the sale.
Deputies say it was the same address the agency was able to confirm through state driver's license and FCIC/NCIC records as Erclauz's residence. The affidavit also notes that the Facebook profile photo matched.
When a PBSO deputy pulled up to the home that night, Erclauz saw the marked patrol unit and ran toward the back of the residence, according to the affidavit. The deputy wrote that he was not able to make contact with him at the scene.
The scooter, however, was still parked and locked on the sidewalk in front of the house. Using the HiBoy app on the owner's phone, the deputy was able to pair with the device and unlock it, the affidavit states. The scooter was recovered there.
Investigators also collected a sworn recorded statement from the owner and the witness, along with CCTV footage from the EOS Fitness location, according to the affidavit.
Florida Statute 812.0195(2) makes it a second-degree felony to use the internet to sell or offer for sale property valued at $300 or more that the seller knew or had reasonable cause to believe was stolen. The charge is an allegation and has not been proven in court.
The Palm Beach County Sheriff's Office was the arresting agency. Court records identify the victim and a related witness, but identifying information is being withheld under Florida's Marsy's Law victim-protection provision, which the affidavit indicates was invoked.
It is unclear from the available records why more than a year passed between the alleged June 2025 theft and the arrest on June 28, 2026. Court records show the warrant was signed in December 2025 and remained outstanding until last weekend.
Attorney information for Erclauz was not listed in the records reviewed for this report.
