Lake Worth Neighbor Sues Palm Beach National Golf Club Over Alleged Noise Nuisance

A newly filed Palm Beach County civil lawsuit alleges the Lake Worth country club created a continuing noise nuisance affecting a neighboring residential property.

Lake Worth Neighbor Sues Palm Beach National Golf Club Over Alleged Noise Nuisance

LAKE WORTH, FL — A Palm Beach County physician has sued the Palm Beach National Golf and Country Club, alleging that years of noise from the Lake Worth facility have interfered with his ability to live quietly in his home across the street.

The lawsuit was filed June 26, 2026 in the Circuit Court of the 15th Judicial Circuit in and for Palm Beach County. According to the complaint and docket reviewed by Boca Post, the case is Jon Arenstein, M.D. v. Palm Beach National Golf and Country Club, Inc., Case No. 502026CA007208XXXAMB, assigned to Division AA. The complaint was filed by Nicholas B. Arenstein, Esq. of Boca Raton, listed as counsel for the plaintiff.

The filing seeks damages in excess of $50,000, exclusive of interest, costs, and attorneys' fees.

According to the complaint, the plaintiff has lived directly across the street from the country club since June 1980. The complaint identifies the defendant as a Florida corporation with its principal place of business in Lake Worth, Florida, and states the club has operated at the location since 1953. Both properties sit in a residential zone, according to the filing.

The lawsuit alleges that the disturbances began around February 2021, when the country club started construction on a new clubhouse and driving range. The complaint states that construction crews began work at approximately 3 a.m. on or about February 2021, and that the noise woke the plaintiff and his family.

The complaint alleges that the disturbances continued and intensified after the driving range was upgraded in 2022 with new range targets, ball-tracking systems, and a sound system. The driving range sits roughly 450 feet from the plaintiff's property, the filing states.

The lawsuit catalogs a series of specific dates on which the plaintiff alleges noise carried into his home, including music played past 11 p.m. on multiple occasions, lawn equipment operated in the parking lot before 6 a.m., and patrons shouting, playing music, and revving engines in the parking lot late at night. The complaint references a Palm Beach County Sheriff's Office incident report, PBSO Incident ID 202400540913, connected to an alleged disturbance on or about May 25, 2024.

According to the filing, counsel for the plaintiff sent a certified letter to the defendant's counsel of record on or about May 8, 2023, citing alleged violations of Lake Worth sound ordinances. The complaint also states that a zoning complaint was filed with Palm Beach County on or about March 4, 2026, identified as Case No. 2026-03040015, and that an investigation was opened.

The complaint cites Lake Worth Beach Municipal Code Section 15-24.2 and Palm Beach County Noise Ordinance No. 81-7, including residential decibel limits and restrictions on loudspeakers and sound amplifiers during overnight hours.

The complaint contains three counts. Count I seeks injunctive relief to reduce noise levels to ordinance limits, prohibit lawn equipment before 7 a.m., control after-hours activity in the parking lot, and limit alcohol service that the complaint alleges contributes to disturbances. Count II alleges negligence, claiming the country club breached a duty to operate its property consistent with applicable noise ordinances. Count III alleges private nuisance, claiming substantial and unreasonable interference with the use and enjoyment of the plaintiff's home.

The lawsuit seeks damages, pre- and post-judgment interest, costs, and a temporary, preliminary, and permanent injunction. The plaintiff has demanded a jury trial.

The filing reviewed by Boca Post does not include a response from the defendant. The case is newly filed in Palm Beach County Circuit Court, and the allegations have not been proven.
