BOCA RATON, FL — A Boca Raton couple has filed a civil lawsuit in Palm Beach County Circuit Court against the current and former owners and managers of a West Boca apartment community, alleging that mold and water damage inside their unit caused serious health problems and forced them to terminate their lease, according to the complaint.
The complaint was filed by Norma Suzanne Urbaez and Priamo Urbaez on June 22, 2026. It names eight defendants tied to two ownership and management eras at the apartment property located at 10147 Boca Entrada Boulevard. The property previously operated as Cielo Boca and now operates as The Seven at West Boca, the lawsuit states.
The case, Urbaez v. Cielo Boca LP, et al., Case No. 502026CA006961XXXAMB, was assigned to Division AK in the Fifteenth Judicial Circuit's Civil Division. The plaintiffs are represented by Patrick L. Goss of Goss Law, PLLC, in Miami, court records show. The lawsuit seeks damages in excess of $50,000 and demands a jury trial.
The named defendants include Cielo Boca LP, Cielo Boca GP LLC, American Landmark III LLC, and American Landmark Management LLC, identified in the complaint as predecessor ownership and management entities. The complaint also names 10235 Boca Entrada Owner, LLC, doing business as The Seven at West Boca, along with Grand Peaks Property Management, Inc., Grand Peaks Properties, Inc., and Grand Peaks Development, Inc., identified as successor ownership and management entities.
Allegations from the complaint
According to the complaint, the plaintiffs resided in Apartment 1-122 from in or about 2021 until they vacated on or about March 31, 2025. The lawsuit alleges they reported mold, water intrusion, and moisture conditions to the predecessor entities during the summer of 2024, and continued to report problems after the property transitioned to new ownership on or about November 1, 2024.
The complaint alleges that Palm Beach County issued a Notice of Violation on or about January 13, 2025 relating to the property, citing code issues that included water damage requiring correction.
On or about February 13, 2025, Norma Urbaez submitted a written resident service request to The Seven at West Boca stating that mold was building inside the apartment, including in the master bathroom and at the entrance, and that the condition was causing health issues, according to the complaint. The filing alleges the issues remained unaddressed and that the plaintiffs broke their lease and moved out in late March 2025.
After move-out, The Seven at West Boca issued a Final Account Statement dated April 10, 2025 that asserted a lease termination fee, the complaint states.
Claims and injuries alleged
The lawsuit brings two counts against all defendants: negligence, and negligent failure to warn combined with breach of habitability. In plain terms, the complaint alleges that the property owners and managers did not maintain the unit in a safe and habitable condition, did not respond adequately to repeated complaints, and did not warn or relocate the plaintiffs after learning of the conditions.
According to the complaint, Norma Urbaez has suffered ongoing health problems including asthma, migraines, sinus infections, rashes, dizziness, allergic reactions, and episodes of vertigo. The complaint alleges that Priamo Urbaez has experienced aggravated asthma, respiratory distress, and worsened lung-related symptoms, and has required steroid treatment and CPAP breathing support.
The plaintiffs seek compensatory damages, costs, interest, and other relief the court deems appropriate. They are seeking joint and several liability against the defendants as allowed under Florida law, court records show.
Case posture
